Hmmm….
The collecting agency doesn’t have to prove a crime. They just collect the money. They also get to keep it and benefit from it. The victim of this seizure is on the hook for proving that THEIR money was acquired legally.
What could go wrong with that?

The county prosecutor’s narrative: We have no idea who owns this money, but we don’t think Johnson does. Our conclusion is based on three facts: He wasn’t sure exactly how much money he was carrying, he couldn’t show that the money came from his business bank account, and the money smells of marijuana.

What money doesn’t smell of weed? What law requires a person to know how much cash is on them? I’m violating that one, right now. Why does the money have to come from his business bank account?
How about this…. What crime did he commit, and what is the proof that he committed it?

His lawyers narrative: excuse me judge… Can you tell me “exactly” how much money you have in your wallet? Question #2…for the DA… isn’t it true that most all cash has drug residue on it?

We had a NDDA certified dog in a unit I was in for 8 years. He didn’t alert on cash thousands of times.

Another reason the po po and system sucks donkey balls, your guilty until proven innocent these days… I cash checks large checks all the time and store the cash in various places and our POS system frowns upon cash of any amount these days. Now if I want to go to my bank and withdraw $25k of cash I have to place an order for it ahead of time like an Amazon order… Sad Sad times we live in,,,

You’ve got 1 vote to use. If you want to use it to undo all asset forfeiture law just make sure you push the D button. Those are the politicians of money launderers, drug dealers and other people who won’t work for a living and are the same politicians who oppose asset forfeiture laws.

Like many on here, I save money in cash. My cash, that I earned. As with many others it would take forever to provide the withdrawal information over the years where I pulled cash that wound up stashed away. I’m confident that I would get my money back, but damn frustrated that I would have to prove it was mine. I sure couldn’t do it beside the road on a traffic stop. I pay my taxes, vote my conscience, and don’t break the laws past class C misdemeanors. I may look like a mule but not a drug mule.

The problem with this narrative is the words “we don’t think”…. Since when is a prosecutor’s decision based on what they think instead of what they can prove?
