Is the system perfect? Of course not. There are certainly cases where LEOs abused their power based on technicalities. But there are many more cases where the LEOs do what makes sense. I've been the recipient on both sides. You have to take the good along with the bad.
The media and the public simply loves to hear about extreme cases - good or bad - where technicalities come into play. It makes for good copy and ratings and fun discussions.
But in the end, debating the finer points of law and technicalities is about as meaningful as kittens squealing in a cardboard box. If you ever find yourself in a situation, the BEST advice is to do what makes sense depending on the circumstances, listen to the LEOs, and don't risk your health, life, or liberty at any time. I can't think of much in life that's worth it - especially the older I get.
