Friends were happy. They found a buildable, 7,500 SF lot down at a highly desired in town neighborhood and were surprised the pricing was actually under the Appraisal District's listed value of $632,500. With a price set at $625,000, they imediately contacted the realtor who represented the out of town owners and submitted a full price cash offer which was immediately accepted. Closing quickly set up at title company with sellers handling thier end remotely. They timely produced notarized documents and accepted payment. That was on July 8th. On July 26th, the purchasors got a phone call from the title company. The real owners of the land were actually disputing their appraisal value with the Appraisal District and were informed, they no longer owned the lot. That was "news" to them. Someone, from somewhere, had contacted the local real estate agent representing themselves as being the owners, never met with the realtor, got the property listed, forged signatures and used a notary stamp that had been withdrawn from the state earlier this year. "Evidently", the oriiginal notary has no idea as to who these people are or how they got that stamp.
The title company has to make this situation whole, but let this serve to all - BEWARE. There is some real scum out there and some of it is rather highly sophisticated.

Agree, title company should make your friends whole! There are a lot of scum bags out there! Constantly having to verify e-mail's from what appears to be folks that we have some sort of association with.

But will the title company make them whole? That's what the 20 pounds of paperwork consists of - they document that they aren't responsible for anything, and you get to pay them a lot of money for saying so. (And they get to act really important...at the closing, and around town.)

7,500 square feet for $625,000  Makes me feel really good I got 3,049,200 square feet for $140,000

This happens all the time with land. It’s incredible how many people, on all sides of the transaction, fall for the scam.

Buddy of mine showed up to cut hay for a lady the other day, and there was a Realtor/For Sale sign on the gate. He called the owner, no, land was not for sale. They called the realtor who said the lady's husband called to list the property. Only problem, the real Mr. died three years ago. Realtor was pretty upset; my thought was, did you not do any due diligence?

There has been an uptick recently in Property Titles being fraudulently changed into another name and then sold. While researching companies that you can pay to monitor your property I ran across an article that said some counties offer Consumer Notification Services. So when I checked my county (Williamson) they do offer the service for free and it took about a minute to sign up. You may want to check your own county to see if they offer it.

Do they have fraudulent title companies? It looks to me this would be difficult to do? All the properties I own have gone through a title company. I guess I’m asking, how does this scam work?

I have never been a fan of the remote signing and mailing of documents, it has always worried me. I wonder what the chances of recovering $625,000 is? And if the realtor got paid? Does a realtor share in any responsibility by representing a bogus property?

This kind of scam can ruin someone's life. I haven't been a victim of this (yet), but we were victims of someone we knew screwing with, as in trying to change, an elderly relative's will. This was an acquaintance that was knowingly trying to take away our family's livelihood - from my elderly mother, from my mentally handicapped brother, and the rest of us, for his own personal gain. It's the kind of scenario that the thought of handling the situation, let's say, "outside the legal system" comes to mind. 'Not saying I would, but it crosses your mind.

Seems like the likely target would be tracts of vacant land, unoccupied houses, rentals, etc. that are likely not visited very often by the owner.

I read about a couple who saw a house listed - they contacted the realtor and put a contract on it. Turns out the realtor had never met the sellers (the scammers) - the buyers lost over 600K - the Title companies Notary approved the scammers signatures - end of the day the Title Company had to eat the 600K -

It happened to a bunch of houses on deep Camp Bowie West in Fort Worth. It’s not anything new and these occurred back around 2001.
