Question- do these two have the right to go and cut whatever they want? They showed up at a family property and just murdered some trees. I’m talking mature trees cut mid trunk. They drove all over the property unannounced, left ruts etc. I have a feeling I know the answer but just curious

They can do whatever regarding cutting within the easement, outside of that they would need permission.

Within the boundaries of thier right of way, Yes, they do. They did the same thing at our place too. Terrible ruts, and they don't care about tree value, or age of tree, or beauty. If it encroaches on the right of way, it gets cut. And not trimmed up all pretty like. The fastest, easiest way to cut it so that it no longer encroaches on the right of way. They have to protect the powerlines, and trees can damage powerlines during storms.

They can pretty much do whatever they want and it's actually worse when they leave things be. I had a red oak on my property explode during a heavy wind and ice storm when it got pushed against some power lines.

Absolutely, if it’s in their right away. I promise whatever you think the tree is worth, isn’t near as valuable as the 7 figure fine they can get if a tree damages a line.

My electric company contacted this out for the past few years and we get 2 man crews in a bucket truck that can’t speak English. When I went to tell them not to try to cross a ditch that crosses under the line, the guy just kept saying “10 feet “. This was the only thing that he knew to say. I laughed and went in the house. Fortunately they didn’t try and cross the ditch, it would probably have taken 2 large tow trucks to get them out.

Not entirely true. They do have to leave the property as it was before with the exception of the trees. i have a division of my land and ranch management company that contracts with ONCOR, they pay me to grade any property damage such as ruts and ranch road damage. If it’s a hay field then will even pay me to seed it back.

Takes a few phone calls to find the right contact but there is one for your area. If you aren’t an azz about it I’ve found they are pretty fair. They are paying my company to disc, drag and seed one of my own pastures where their bucket trucks drove across it for weeks rutting it ok so bad you would chip a tooth driving it. I respectfully made a call, met the area foreman and told him i was fine to wait until they were completely done. They even paid me for lost crops since I wouldn’t be able to bale it until it grew back.

It’s funny they will cut whatever trees that are in the ROW even if they aren’t really affecting the lines. But when I need them to either cut a tree back or remove the lines so I can hire a crew to cut the tree back, they don’t want too. I have a tree that’s about to rip the power line off a neighbors house, power company doesn’t want to do anything about it. I’m about to get the city inspector involved and he will shut power off at the house until it’s rectified.

If you've got acreage, best you can do is ask them to leave the pile of mulch for you (in the location you specify). Free/delivered mulch ain't a bad deal if ya got a use for it.

It’s not a fun situation at times as a property owner but yes they can cut whatever they need to in the easement and you have zero say so about it. We’ve cleared more miles of ROW’s than I’d care to remember but the catch is they have to stay within the easement however a lot of guys don’t. Depending on how the easements are documented they generally need permission to cross your property to access it but regardless any damage created will be their responsibility. If you have any complaints simply contact your power provider and they’ll point you in the right direction, once you get the right guy on the phone they’ll have the problem fixed immediately.


Some of these guys feel like it’s easier to ask for forgiveness afterwards than permission beforehand, these are the same dipchits that trash everything and leave a mess behind. We’ve had to go in and fix some bad screw ups over the years idiots caused on row’s but for the most part the big equipment guys are good respectful people, the hand crews not so much.

Did similar on our place a while back as well as drove over and caved in our septic tank. The num nuts operator had the decency to wrap it in orange flagging so… but failed to report it. We called AEP a month after it happened and they had no idea. Bet someone got fired over that. Anyhow we got a new septic.

The ones that were here on behalf of oncor had the jefe come by and
talk about what they were going to do, etc. and left a card with his
name and number, and said they'd need to access through my back
gate, and please leave it open so-and-so days.
Huh ? No ,you call me at the number you took the trouble to get from
me, and I'll be right there to unlock it, and lock it back up when you
leave for the day. Well. . Ok. We'll be here tomorrow at 7.
7 comes. No crew. 9. 12 noon. 3 PM. . . Nobody no crew no phonecall.
I call the number and get a coordinator lady. Hmmmm. . . Sir you mean
nobody came by or called ? Yes maam that's what I just said.
Long story short, they eventually made it there and made a bfm and
cleaned at it and left plenty of smaller branches scattered everywhere
plus water bottles and earplugs and a brand new rake. I hope whoever
was responsible had to buy a new one.
I could have done as well by letting some of those border jumpers that
drive around in a pickup truck and no habla have at it

Oncor absolutely sucks - worst run company I have ever seen. Our area has encountered many outings because they DON'T trim the trees - also impossible to speak to a human there - rant over

Don't get me started on Oncor. One of their bucket trucks hit the overhead pipe on my gate breaking a bunch of welds and pushing the whole thing over. I'm still waiting to get paid for that.

At the back of my property, I have trees growing through the power lines. Since they can't get back there with heavy equipment because of two creeks they tell me its not a problem.

Many moons ago straight out of High School (1974) I worked for Asplundh Tree Trimming Expert Co. trimming the trees away from the power lines for then Dallas Power & Light.
If memory serves me right, in Dallas we only asked permission from the home owner in the nicer neighborhoods north of the Trinity River and probably Kessler Park in Oak Cliff.
We actually knocked on their door and got verbal permission.

When they trimmed the tree limbs from our Red Oak in the back yard away from the power lines behind our house they did not ask permission and they cut limbs that were inside our property line.
I went to Oncor web site and there is no information about whether they have to give notice to the property owner before trimming their trees.

It all depends on the language of the easement. You would have to review that.

This assumes they have one. I had Oncor trespass on my land years ago, cut my gate lock, and did some damage.

I worked out a settlement deal with them to get me free electric lines but ended up selling the property before building.
