Looks more red deer than elk.

First make sure your lease or LO expresses permission to kill exotics.

Once permission is established make sure you aren’t next to the Moncreif Ranch and you are probably good if not tagged.

I really think the elk transfer to “potentially” livestock is BS.

Some will try to catch them (mainly darting) some will say to just shoot it.

100% don't shoot an animal with a tag -- even a legal game animal, unless you notify and confirm with your local game warden. Just easier that way to be certain. Just takes a simple phone call.

I say red deer, check with land owner before shooting. Doubtful others are around free ranging so a population won’t be possible.

White tailed deer during season, ear tag or not, are fair game and can be taken, assuming you are hunting on owned or leased land. That’s also assuming it’s a legal deer and your not on the originating property where the deer came from and covered by a contract.

If you see an ear tagged amazing white-tailed buck on owned, leased or public land can you legally kill and claim it during season?

Can anyone provide documentation saying you cannot?

I don't know how it applies, but there is this regarding elk.

(3) "Livestock" means cattle, horses, mules, asses, sheep, goats, llamas, alpacas, exotic livestock, including elk and elk hybrids, and hogs, unless otherwise defined.

Are exotic animals that happen to show up on my property fair game?
It depends! If an exotic animal has a visible tag, brand, or other identifying mark, a person should contact the local sheriff's office and report the exotic animal. Texas estray laws apply to marked exotic animals and the local sheriff is responsible for their enforcement. Exotic animals that are not marked and are free ranging that have wandered onto private property may be hunted with a hunting license, provided the owner of the property allows hunting. However, if an exotic animal appears on your property and you know that it is privately owned, then the ethical approach is to contact the owner.

When I see a tagged animal (regardless of what it is) I'm going to check on it. There's generally no harm in checking in on it and you may learn something.

For example, I've passed on a doe that was tagged by Oklahoma and part of a study of their habitat/movements etc. (I hunt near Oklahoma). Could I have legally shot that animal - sure. Worth it? Eh, for every hunter to decide.
