"In August 2020, Jerry flew to Phoenix with the intention of returning home with a semi-truck from an Arizona auction house, but instead he returned to Charlotte without his money and without a truck. Even though he was never charged with a crime, an Arizona trial court ruled that Jerry failed to prove the cash was his and, therefore, could not contest the civil forfeiture of his money," the IJ explained.

Story

Has to be among the worst laws in the country. bang

Yep, the government can't control the drug dealers and criminals so the law abiding have to pay the price. NO different than the "gun" being evil. Pfhuck those sorry sock cuckers.!

If only there were something in the constitution covering illegal search and seizure.

Sounds like a likely story. Tell me why he couldn’t take his pay records/bank records in and show that he withdrew that money legally for the auction? You could do that. I could do that. Why couldn’t he?

"The state court in Arizona, however, found, "This was a not a trivial or technical error."
It found the lower court violated Jerry’s right to due process.
"The decision further affirms that 'Johnson in fact proved he owned the money,' granting Jerry a complete victory on his appeal," the report said."

^ yep, sounds like he's on the side of "I'll take your money any time I want"! Guilty until you prove yourself innocent in his eyes.

I know a few people that have a lot of cash at home that there is no 'paper trail' on. None of that cash is illegal in any way whatsoever and just been put in safes a little at a time for many, many years. I'm not talking about a a few thousand dollars here. So, If one of those people wanted to take a couple hundred thousand out of it and go to an estate sale or an auction of some kind and were pulled over and they seized it, how would they go about proving it was their money and 100% legit???

Sorry, but I'm of the opinion this is still America and you are innocent until proven guilty and not the other way around.

I have a stash of cash that I have made off of selling scrap metal I have never placed it in a bank so if I was stopped with it I would be hard pressed to show where I withdrew it.

Also the legal system should have to prove that I am guilty or the money was obtained illegally that is one of our tenants or was!

I understand civil forfeiture is a useful tool for law enforcement at times, but there is some abuse that trips up law abiding people, which is unacceptable. Especially with how hard it is for some of them to get their money or property back. There needs to be some change to protect non-criminals who are not committing crimes, in my opinion.

In this period of high inflation, it seems crazy that $10k is the max that anyone can fly with when going international, esp. when cash is still king in many countries.

People that have never been self employed do not understand people that are. I’ve know folks that worked for themselves their whole lives that have cash stacked away in every nook and cranny of their house. Some folks don’t trust banks much. Doesn’t make them criminals.

About 5 years ago I got stopped by US Customs at DFW Airport flying to Japan (JAL). I was walking down the jet bridge to get on the plane mind you. They said their "dog alerted" and that I had "extensive amounts" of cash on me. I told the azz clown that I had $1,800 on me. He made me show it to him and he counted it. I guess that is extensive. I laughed at him the entire time.

Didn't know they had cash sniffing dogs that could predetermine the amount of cash you had on hand.

I didn't either.

I've read where approximately 90% of US cash money contains drug residue on it though. Seems hard to believe there are that many dope heads out there.

You can carry more than $10K. Just have to declare it.

To be determined

If those "cash sniffing" dogs can also make change there are a lot of fast food/retail jobs where they could advance into management pretty quickly...

If you reported this as income on your tax returns, you should be good to go.

You can fly with more than 10K cash, you have to declare it on the way out of the country, or coming into the country. There are signs everywhere in the ports-of entry.

That being said I thought it was opening the door for misuse when the law was passed. And it is being used by Fed, state, and local agencies to add to their budgets. The really wrong part, imo, is that YOU have to prove it is not ill gotten gains. That's wrong.
