I read the article. That is the exact same arrangement most people use to buy a house. The homeowner has title, but issues a deed of trust to the entity that loaned them the money. If the homeowner defaults on the loan, the property goes through a nonjudicial foreclosure and is sold at auction.

They just take it. The state files a civil suit against the landowner and a panel of commissioners assigns a value to the property. The court issues a judgment transferring the property to the state and ordering the state to pay the value to the landowner. If the landowner disagrees with the valuation, they can challenge it in the law suit and appeal the judgment, if necessary. It's all civil law, nothing criminal involved.

The alleged abuse of eminent domain is related to the support economic development as opposed to a public works like a dam or a public road. The opportunities are endless.

They really are. The Supreme Court has said that eminent domain can be used for something as commercial as a shopping center because it will benefit the surrounding area. By that logic, just about anything would be permissible. However, something like a railroad has always been permissible in this country and is really the kind of project that was intended.

If three people are in a room, and two of the three become hungry then kill and eat the third, it can easily be argued the meal was in the public interest because the majority benefited from the transaction.

Does that explain eminent domain clearly enough?

I rode a magnetic levitation train in China. From Shanghai to the airport. About 30 miles. I think it got up to around 180 MPH. There were two of them. They each left either Shanghai or the airport at the same time. When they met in the middle at that speed it made a heck of a sound. There is no way something like that could ever be built here. Too much political and environmental BS to contend with. Not counting the money and time it would take.

My wife and I rode AmTrack from New Haven, Connecticut to New York City in 2018. We went in the middle of the day and it wasn't crowded. I asked the conductor how crowded it was at rush hour and he said, standing room only. I rode on a high speed train in 2017, meeting another one with both going 140 MPH (top speed 150) does make a heck of a sound. It also happened so fast, if you blinked you missed it. Don k, I can imagine what they sound like at 180 MPH.

Yes I remember it well. We were pouring the precast concrete tunnel segment liners for it. Tightest plus or minus spec I ever saw in my 35 years producing precast concrete! We were glad they cancelled our contract cause not sure we could have made enough good ones to finish it!! roflmao

But those potential beneficiaries are far less organized than are the train’s critics. For years, an army of county judges, landowners, lawyers, and right-wing interest groups such as Tim Dunn’s Empower Texans have opposed the project under the banner of property rights. Railroad companies, however, aren’t the only ones permitted by Texas law to acquire land through eminent domain. (The holding company that owns Texas Monthly also owns interest in oil and gas pipelines, among other diverse investments.) In early November, Steve Toth, a GOP representative from the Woodlands, pre-filed House Bill 114, which aims to restrict the ability of state agencies to grant high-speed rail permits. More anti-rail legislation from Republican legislators is expected. In the absence of outspoken advocates, the session may kill any momentum the project had left."

From what I understand the cost and income potential have bee grossly over for cost and grossly under for income so the difference will have to be made up by the tax payer plus the deflation of property values
Yes I do have property that will be affected so obviously I’m not for it
This is foreign companies pushing for this the hardest now with covid how many years will it take to fill the cars with people if it can’t pay for itself with full cars how can it 1/2 empty cars
We have some responsible politicians bringing all this information to the tax payers about projected cost and the real cost

I think the legislature is going to kill it. The lobbyist will have a lot of work to do to keep it alive without Abbott.
