With hunting over bait being illegal. If you have a deer feeder near a pond. How far away from the feeder do you have the be in order to legally hunt the pond?or should I ask how far does the feeder need to be away from the pond? Say the pond is about 1/2 to 3/4 an acre.

If that bird is anywhere near the flight path of going to the feeder, no matter where that pond is, liable to be in trouble.

The standard for "warden's discretion" is going to be the issue...if you have doves or ducks coming to and feeding from the feeder...warden will require a complete cleanup of feed and then 2 weeks "rest" time for the spot., before shooting would be legal....if you have a feeder and you can see the tank that ducks are landing on you may be okay...but if ducks can waddle up to the feeder from the edge of the tank and feed, or doves are flying in to the "feeder zone"(the area where the feeder deposits the feed) then by regulation that is a "baited" area.

IF the feeder is on the property -------- he can give you a ticket -------- period. That puts us back to 68A's post ----------- game warden's discretion.

I don't think so. Its the fed that normally shows up for baiting, normally on a tip. I had a local GW tell me that and it makes sense. Here is my take on this. There are 2 aspects to the baiting law. In general.. 1) You cannot hunt migratory bird "over" bait, "over" is the key word here. So you cannot sit over a deer feeder and hunt migratory bird, period. So if deer feeder is on another property, and you are across the fence don't matter. 2) You cannot use bait as an "aid" to kill birds, "aid" is the key word here. The issue here is if the deer feeder is holding birds. If a deer feeder is not holding/attracting birds, it is not "aiding". And you are good. If it is holding/attracting birds, then this is an issue. Because if you are killing birds going to that feeder, and that feeder could be 10 miles away, you could get a ticket for this, especially if GW (normally a fed) has done his investigation and has built a case against you which normally they have, and can show you have petterned the birds and killing them on the way from roost to the feeder. When fed GW show up, you are getting ticket for something, they are not making a trip to your property to go home with no tickets. I had duck lease for years, owner put deer feeders on it, I didn't like it, but they never held/attracted birds so I did not worry about it. If they held birds, then that would have been a problem.
