According to their own rules, I don't see where he violated anything.
"A student will not dress or groom in a manner that disrupts the educational process or is detrimental to the health, safety or welfare of others. A student will not dress in a manner that is distractive or indecent, to the extent that it interferes with the teaching and learning process, including wearing any apparel that displays or promotes any drug-, alcohol- or tobacco-related product that is prohibited in school buildings, on school grounds, in school-leased or owned vehicles, and at all school-affiliated functions."

and the "spoiling for a fight" attitude is why we have a fight to begin with. I gauranf'ntee you if he was wearing a "rainbow coalition", GLADD, Lean Forward, MLK, JJ, or any other left winged outfit he would be applauded for his bravery.
The PC crowd has no tolerance for anything that does not fit their agenda, legal or not.

Well-spoken 8th grader. Wearing a shirt supporting an ammendment to our constitution should never cause this sort of disruption. Had the shirt been supporting ANY other ammendment, this wouldn't even be an issue, especialy to a teacher. Granted, it might have gone over better had he quietly left school then contacted the press about how the teacher disrupted his educational process by raising a stink over his shirt which violated no written regulation. Or turned the shirt inside out and told how his 1st ammendment rights were violated by the teacher.
edited to add: Of course, had he taken either of the two above options the media would never run the story. Except maybe Gun Talk.
