Wow! I go to the duck lease for 3 days and yall been busy. Alright. The last post I put on this subject was on my
Iphone with horrible service. I had called the state and got no statute other than, "You just can't do it".

Today. I talked to a state and a federal game warden. Given the exact question asked at the beginning of this thread, the state warden laughed and said "That is the dumbest thing I have ever heard". Notice the quotation marks fellas!!! His mouth to my ears.

Federal. Same question! He said as long as you are still in possession of the birds (you are standing right there) and you can say "I shot this one-this one and this one, it is not a violation of federal law. He went further to say, "If you left your birds in the blind with a friend as you go retrieve a downed bird, you nor he are in violation even though the birds in the blind are not in your possession". There is no intent to abandon the birds. He said piling them up for a picture is not illegal as long as you can state your possession (Which birds belong to who).

I am going to keep rocking on the way have done things my whole life. I don't want to pole at any bears, but I dern sure don't want to walk around in life afraid of the government. Thus the reason for the question as to what statute was it.

Yall think we can puch this to 20 pages?

And this is the problem. Apparently you ask 10 different game wardens you get 10 different results.

If they want to enforce the ridiculous rule it should be stated explicitly.

Can't wait until the day they make you take an ice chest for each fisherman so you don't end up "piling" your fish.

I guess nobody has a duck hunting buddy out there that tries to claim every duck that hits the water. Although I like hunting with those guys cause I let them claim it and then shoot my six birds. Except for the one time that I retrieved "MY" duck brought it back to the blind and my buddy tried claiming it. Finally got tired of arguing and told him fine you shot it. He then hands me the duck and it was a banded blue-wing Teal. I retrieved it in darn near waist deep mud because I was certain I shot it, but never saw the band. He put it in his pocket and lost it sometime between the blind and the walk back to the boat.

My buddy that I was with actually called the GW and asked about the fish thing. They told him legally you have to be able to pick your catch out of the cooler. Basically the same for ducks. You can have them together but each hunter/fisherman has to know specifically which one he shot.

It may have been mentioned already but got tired at page 6 or seven. I only hunt private land so the pile up pic prob is almost out of the question. But I think it was Cody Malone that was talking about the limit strings he was making. Use something like that while hunting public lands and lay the birds out and if ask each hunters limit is proven separate. Attached to the feet wouldn't show up in the pic.

I guess you missed the part where you don't have to keep them separated. You just have to be able to identify your birds.

ok...

Since I was tired of Spoonies giving all his attention to the forum (and not me angel ), I figured I had to do something. So I emailed a game warden about 3 days ago and just got a response back yesterday.

My Email:
A recent debate among friends came up as to whether or not it is illegal to pile birds while hunting in a group. I realize that you are technically supposed to keep them separated so others in your group do not shoot over there limit. I am also aware that when you get checked by the game warden he asks for them to be separated into who shot what. There have been several comments on certain laws that talk about possession of migratory game birds and such. Out of all the times we have been checked at the boat ramp, not once have we received a citation for having them all together on one strap, or for having them in one pile. The GW usually just asks us to please separate them, then he proceeds to check every bird to make sure none of us went over our limit. Is there an actual law anywhere stating that the birds must not be together while hunting or transporting them from the hunting site to the boat ramp? I would assume not, since we have never received a citation for this. Can you please clear this up for me? Maybe show me where I can find a law stating that it is illegal? in the book, § 20.38 Possession of live birds, and § 20.37 Custody of birds of another say nothing about comingling. Is this because it depends on each game wardens interpretation of the law?

I was hoping he would email his response, but instead he called. He said:

Although the term "comingling" is not used in the possession laws above, and even though the law is kind of gray in some areas, this IS the law regarding piling ducks. Although its the law, they don't really enforce it because it is a common hunting practice in Texas. Buy technically you are in violation. He also said: Say 4 people are hunting and all the birds are in one pile. If the warden asks you to seperate them and there is one extra and nobody fesses up to shooting the extra bird, the one that owns the boat or truck will be in violation and will recieve the ticket.

He said that he also sent my email to the Fish and Wildlife Service and will email me their response if he gets one back.

I hope this post ends this stupid thread for good!!! boxing

And for all of you grammar and spelling teachers out there, yes I realize I used the wrong form of "There" and that it was supposed to say "their". I wouldn't want to get harassed as much as that poor johnboy kid that ya'll were so mean to!
