I thought this was legal but wanted to get a few more inputs before actually doing it!!

My friend is buying a o/u shotgun and I was going to get my buddy to ship it to me from Houston.. I always heard that shipping in Texas from person to person is legal!! Also if need be I can seperate it and ship in 2 pieces!!

Please let me know what If u have info on this!!

Inside the state of Texas yes-cannot cross state lines

Both Parties must be of legal age and not prohibited from owning a firearm.

A common carrier must be used (not US post office)

actually, usps can be used. They take longer, but they will accept rifle/shotgun shipments.

I shipped a rifle to Savage...Crossed state lines.
Had no issues.

I bought a cheap gun case at Cabelas and then went to the gun counter and asked for a box big enough to fit it in.

I believe mailing handguns is illegal. Not sure.

Savage is an FFL manufacturer. You can ship guns to then, and they can ship back to you.

Savage was the mfg, and they are the FFL, so you can ship it to them across state lines.

Shipping handguns is not illegal. They must go through an FFL, no matter what.

Long guns, individual to individual within the state of TX is perfectly legal, and the post office will do so.

Hand guns have to go thru an FFL irregardless.

Incorrect according to the ATF.

Rifles and shot guns - USPS (unmarked and unknown contents) or common carrier (unmarked - carrier must be notified of contents - carrier not allowed to mark package as to contents)

Handguns - common carrier ONLY (unmarked - carrier must be notified of contents - carrier not allowed to mark package as to contents)

I don't necessarily see the problem with it if Able Ammo conducts the NICS check on site before shipping, but their policy seems to be that they only go through your FFL.

That's pretty much how it works. It could be that in order to conduct the NICS check you must be present, so doing it over the internet just wouldn't work. Or it could be that they just want your FFL to go to the trouble of it.

But no matter what their reasoning, you're pretty much stuck with finding a local FFL to accept the firearm before you get it.

To answer the OP: You can ship between private persons in-state using USPS. No special requirements for shipping, but I'd definitely insure it and add delivery confirmation. I shipped out a Remington 870 not too long ago using USPS, and it got there without a single problem. The clerk didn't give me a second look when I confirmed that I could ship a long gun.

If you buy online and pick it up at their store in Huntsville then yes because they will do the NICS check there; otherwise they will have to ship to FFL.

To PURCHASE a new firearm the background check MUST be performed in person so the dealer can verify the purchaser. (with DL or CHL) If I got online or over the phone and told the dealer my information I wouldn't even need an id. So to purchase you have to do that through an FFL. To sell to a private person like on the forum. You could ship the gun as long as the package is tracked. So USPS, UPS, Fedex, DHL as long as you maintain tracking on the package.
