my understanding of the law is that you can not shoot a dog unless it is harming your livestock(must have proof) or you fear for your well being. Just because a dog is on your property doesn't give you the right to shoot it dogs can't trespass.

I have a BB gun and it works fine!!! You can send them scooting and they won't forget! I don't know if you live in town or out but if you're in town find out where the dog(s) live and turn them into animal control and when they get cited a couple of times they'll leash their dogs. Coleman is one of the worse towns I know of that won't enforce the leash law. So I do a little animal control of my own. If the B B gun doesn't seem to work then I go talk to the owners!! In reality the owner should be shot with the BB gun and not the dog!

No need to worry about the law as Texas State law provides that if your livestock are threatened by man or animal on your private property you have the right to protect your livestock with extreme prejudice. The law DOES NOT state that you cant shoot a dog for the same offense as it IS acting as a predator. If your neighbor has a problem with you following your right to protect your animals on your land then keep them on his own. The police may not like the idea of a dead dog but you sure cant get arrested for it. The most that they could try to do is call animal control and site you for animal abuse but once again your are protecting your land and livestock not just going out and shooting a dog for no reason. Your still protected by the good ol'law. Happy huntin.

Dog owners need to be more responsible I will shoot and ask my self a cow? A Horse? A Hog? What about my daughter? Not a chance in Hell! Here is the exact law as written under Texas penal code
Section 42.09 column E.

(e) It is a defense to prosecution under Subsection (a)(5) that the animal was discovered on the person's property in the act of or immediately after injuring or killing the person's goats, sheep, cattle, horses, swine, or poultry and that the person killed or injured the animal at the time of this discovery.


So if you catch any animal domesticated or not killing your livestock you are protected from any animal abuse charges and civil charges when you kill this animal.

Honestly it all depends on where you are located(city, small town, country, ect...)...all situations are diffrent.

As for us, we live WAY out in the country & have had a dog come thru that was sweet & nice & he stayed a bit & then went on his way & then we have had a pack of skinny, NON-social, aggressive dogs that were all shot on site due to small kids, livestock, & pets. Like CH said, a BB gun works wonders in areas(towns) that the animal more then likely is a pet. Out here 98% of the time they are no longer pets but a threat. Each situation is diffrent & needs to be looked at it diffrently to keep you & the dog & owner within the law & to make sure someone isnt just out there killing dogs for the h*ll of it & such. Most times you just need to "use your head" & it will be alright.

The trouble is some jackass will more out to the country from the city, get 5 acres and then get the biggest dog that they can find. Unless you got 1000 acres and you make your living there (i.e. your home most of the time) you need to keep your dogs penned or chained. Otherwise when you leave they are being a pain in the arse for someone else.

Exactly. Just because it comes on your property doesnt mean you can legally kill it.

Look up House Bill 151 (HB 151).

You have the right to protect livestock, but they do have to be in the act of harassing or attacking LIVESTOCK.
Furthermore, if you have proof the owner of the dog is responsible for the financial loss.

It appeared as if there was something in the works to make this even stronger.
