We have this big hayfeild with a stand on top of the hill, about 300 yards down the hill is a fence line. We have a feeder about 80 yards from the stand and the deer have always naturally came along the ladies fence line and into the hayfeild to feed or go to the feeder. Last year it all started when she would drive by right at dark just one time in her little white car. So we put round bales behind the feeder and we thought that would fix the problem between us. NO!!! This year my sister killed a deer her opening morning and the lady was a no show. Yesterday evening my buddy was hunting up there and he said when he topped the hill at 4:30 she was parked on the fence line sitting on the hood of the car. He said she sat there for a while then left and parked down the fence where the deer come out. Then she drove the fence line the rest of the night about 10-15 min apart. He even told me a doe came out and she flew down there as soon as she saw it to scare it off... It seems to me that she doesn't want "her" deer coming on our property. But they have to come over to get water and feed anyways?? I have round bales behind the feeder as a back stop and I've even turned the blind where it isn't facing directly toward her but it's yet to stop her from doing this BS.
Her father is just as bad, "calling" up cows right at dark and even went as far as pulling a gun out to see if we where in that stand, set and watched him do this from another spot. All she does is use binculars to see if anyone is here, like she did last night.

All I'm asking is it ok for her to do this??

No hunter harrasment! You did take steps with round bales to prevent bullet travel...try to talk to the hooch then call G/W. She mayb able to sit there and watch but racing down to scare deer sounds wrong!

Get a video camera and document what is going on. It will back up your word against hers.

Thanks guys,
It does no good for me to feed these deer year around and as soon as deer season comes around, her to ruin my hunts by her driving up and down all evening

I would think if it is her property she can do what she wants. I really don't think we want the law telling us everything we have to do on our own property. If she puts up a high fence are they going to tell her she can't do that because you want the deer to come to your feeder?

It's mostly harrassment.. I here them shoot every now and then and it's like 5 or 6 times and it sounds like misses everytime

Have you tried to communicate with her or her father? That would be my first step. To try and see what their problem is. If that does'nt work then call the GW if the harrassment does'nt stop.

Long term means for improvement would be to plant several rows of pine trees along the fence line. At least she could not see your stand and feeder (in approx. 7 years). Out of site - out of mind. Just my .02

I don't get it... How can one person say it's illegal and the next say it's fine..
I get it's her property but there's no reason for her to chase deer that are trying to come on my land to drink and eat

Another solution. Make yourself one of those round hay bale blinds and put it in a row with several others. Move feeder farther away from her line. My guess is that sooner or later she will tire of trying to second guess when your hunting.

There is a legal precedent for incentivizing the use of natural resources, including hunting. Keeble v. Hickeringill is an English case from 1707 that has been routinely used in the American court system.

Most states have statutory rules akin to the above ruling. In Texas, it is called the Sportsman's Rights Act. Do an internet search for §62.0125 for the specific wording if you're interested in the details.

The general idea is that you cannot be harassed in the lawful taking of wildlife unless that harassment is protected by the 1st Amendment (free speech). Additionally, the statute prohibits harassing, driving, or disturbing wildlife that a person is in the process of taking.

Summary: This law represents Texas' hunter harassment law, also known as the Sportsman's Rights Act. Under the section, a person may not intentionally interfere with another person lawfully engaged in the process of hunting or catching wildlife, or intentionally harass, drive, or disturb any wildlife for the purpose of disrupting lawful hunting. Violation is a Class B misdemeanor. It is an affirmative defense to prosecution that the defendant's conduct is protected by the right to freedom of speech under the constitution of this state or the United States.

(a) This section may be cited as the Sportsman's Rights Act.

(b) In this section:

(1) “Wildlife” means all species of wild mammals, birds, fish, reptiles, or amphibians.

(2) “Process of hunting or catching” means any act directed at the lawful hunting or catching of wildlife, including camping or other acts preparatory to hunting or catching of wildlife that occur on land or water on which the affected person has the right or privilege of hunting or catching that wildlife.

(c) No person may intentionally interfere with another person lawfully engaged in the process of hunting or catching wildlife.

(d) No person may intentionally harass, drive, or disturb any wildlife for the purpose of disrupting a person lawfully engaged in the process of hunting or catching wildlife.

(e) No person may enter or remain on public land or enter or remain on private land without the landowner's or his agent's consent if the person intends to disrupt another person lawfully engaged in the process of hunting or catching wildlife.

(f) This section does not apply to a peace officer of this state, a law enforcement officer of the United States, a member of the armed forces of the United States or of this state, or employees of the department or other state or federal agencies having statutory responsibility to manage wildlife or land during the time that the officer, member, or employee is in the actual discharge of official duties.

(g) A person who violates this section commits an offense. An offense under this section is a Class B misdemeanor.

(h) It is an affirmative defense to prosecution that the defendant's conduct is protected by the right to freedom of speech under the constitution of this state or the United States.

it don't matter if she is on her side of the fence or not you cant run animals off that aren't on your place unless you don't care about getting charged with a class B misdemeanor which is
§ 12.22. CLASS B MISDEMEANOR.

An individual adjudged guilty of a Class B misdemeanor shall be punished by:

(1) a fine not to exceed $2,000;

(2) confinement in jail for a term not to exceed 180 days; or
(3) both such fine and confinement.

I am NOT a LEO or lawyer but but I can read and understand what I read, the info is out there, this is just copy & pasted for general info take it for what its worth from me, which isn't much, I'd call someone who would know for sure and go from there

The blind has been there for 4 or 5 years. She just moved here 2 years ago and she's been doing it ever since. I can see driving by there once during hunting hours but she shouldn't be doing it constantly once she relizes me or someone else is in the stand. And he damn sure doesn't need to pull out a gun to look thru is scope to see if anybody is in the blind

I guess if you see him using his scope to watch you and you got a camera that zooms in enough snap some pics and pay the county sheriff and or game warden a visit with the proof and let them talk to him.

Yeah, that could be a dangerous practice. Pointing a scoped rifle at someone? Doesn't matter if you're on your own property or not, you don't have any good reason to point any weapon at someone not threatening to you. Could lead to a bad, potentially fatal, misunderstanding.
