Certainly didn't mean for this to go all legal. I was just trying to protect the reputation of a friend. But the answer to your question Greg, is not necessarily.

For defamation, three elements have to be satisfied
1. Publication - In this case he posted on this public forum
2. Identification - He identified Drake Plantation by name
3. Defamatory Matter - He said DP was running tamie hunts and many potential clients might shy away from those that practice this.

In most defamation cases, it is the defendants responsibility to prove he did not hurt the plaintiffs reputation or adversely effect future business by posting the defamatory statements. Much different from contracts and general torts.



As I stated above...Be very careful.

Ok, guys, I haven't been on in a few, but looks like I stirred up quite a lil pot. FTR, I should have stated up front that I personally have never been on a DP hunt, nor will I ever. The info I posted was given to me by several others who claimed to have been there & done that. It was about 5-6 yrs ago now & Dp was allegedly letting you shoot all the green you wanted for a fee. Now, IF that wasn't true, then I sincerely do apologize to Mr Fisher, but after hearing it from several local hunters who seperately claimed to have made these type hunts, I believed it then, as I still believe it now. Apparently, I wasn't too far off, as the fella that mentioned Broken L knew exactly what I was referring to. Could it be that the guy running the pen hunts for Broken L used to be part of Fisher's outfit? Whatever the case, I honestly don't care because I know for a fact that neither of them will be getting any of my business. If yall wanna call it slander, then so be it.

Ducksmasher, you know me personally, & we've always had a very good report with each other. Your former collegues also know me & respect me for always being up front, whether I was in the wrong or someone else. If I was the type that would go off just starting crap for kicks, I seriously doubt you or your wife would have ever been as cordial with me as you've been, & I know that I wouldn't have the respect from TPW that I do.

I'll let yall get back to the trash talkin & i-net legal jargin now. Check back in a few days. bounce

I feel like there were only two people with negative things to say about DP and many more with positive things to say. I'd still hunt with them without question.

My favorate thing about DP is it's always an easy hunt with them...there is no setting out or picking up decoys...they take you to the blind or very close to it. You can't say that with most outfits...most of the time you are setting and picking up decoys. It's not really that big of a deal but when I take my dad who is 71 out he likes just going to the blind and getting ready to hunt verse busting your butt setting decoys. Also every hunt I went on was a mixed hunt...shot both ducks and geese. If you want geese only it's really the wrong place...but again when you have expectations set on one thing then and you get another you are bound to be disappointed. For me I love the mixed hunt.

Broken L is great! Hats off to shawn. He goes through 15k birds a year. Books out every year. Do the math. Lots and lots of work involved. I would do it in a heartbeat up here, just don't have the proximity to Houston, Dallas, or San Antonio. There is a market for it people. No difference in shooting quail, chuckar, or pheasant east of I-35. So its not your cup of tea, OK, that's fine, somebody will do it. Not your cup of tea shooting deer that are high fenced? Oh well... later, B. By the way, thumbs up to Shane and Brian...DP

I'd say if people know they are shooting pen raised birds then there is no issue. I've done pen raised quail, chuckar, and pheasant myself....not exactly hunting but it beat staying at home and watching TV. I would not pay to do it for ducks but if someone wants to then they have a place to do it and I really don't see a problem with someone spending money how they want.

The issue would only be if people didnt know and I'm not seeing that as happening based on these posts.
