Here we go...game warden called him today and told him to come and get his deer and his bow. The bow and deer were confiscated on suspision that the deer was shot with a rifle and not a bow. After testing it was determined it was an arrow and not a bullet. Is this legal to confiscate the bow and deer on suspision? I would think there would have to be a citation issued to confiscate anything!

so is the deer still good? i would think any warden could tell the difference between a gun shot and an arrow hole. glad it worked out for your buddy. what county did all of this happen in?

Well, at least he took the spike legally...

I think the warden was allowed to confiscate the game and equipment used on that suspicion... Just like searching a car is legal when the odor of drugs is present I would assume.

Now, why the GW thought the deer was taken with a bullet is unknown and your buddy may never know that.

That wouldn't make me very happy that it came back frozen, since I process my own deer. They shoulda called him and asked him what he wanted them to do with it, IMO.

That is a strange story.Any GW can see the difference between a bullet wound vs an arrow wound.

No new GW's in Cherokee county this year. Unless they were assigned in the last couple weeks. Bearden and Collins are the only two I know of.

a newbie hunter should be able to tell the differnce in a gun shot to an arrow hole. just my opinion! now whats the whole story?!!!!

I've heard GW's talking about catching guys that shoot a deer with a rifle and then shove a broadhead through the bullet hole to make it look like an archery kill.

Maybe the OP's buddy had a rifle with him or in his truck which gave the GW some reason to become suspicious.

And if the GW suspected that a crime had been committed he would be justified in seizing the evidence. Once forensics proved that the deer was lawfully taken then the evidence is returned. No harm, no foul.

fair enough! i just think of the hole my 7 mag leaves or even a 243 for that matter! hard to see what the confusion would be but crazier things have happened!

don't want to stir the pot here but there are GW's with ch*t for brains just like in any other profession. Not saying this is one of those times but might feel differently if it happened to me confused2 that being said a job like that can be hard to do and gets alot of criticism from folks who might not know better. If it worked out then move on but I would politely ask why he felt he had suspicion.

What kind of ballistic tests did they do on the bow. I am sure there wasn't any blood splatter on it.
