I have a buddy who was ticketed by a gamewarden for shooting a spike with less than 4 inches of horn length. Is there any validity to this? I've never heard of this "rule."

Any feedback will help.

Never heard that in Texas, spike is a spike in Texas, which it shouldn't be. Spikes grow up to be big Deer too.

In Oklahoma spike has to be at least 3" or something like that to count as buck.

thought to be legal it just said it had to have at least one unforked antler... no mention of length.

TPWD on Antlers. I don't see any length requirement on a spike, and have never heard of one.

If your buddy was in fact given a citation for this, the name of the officer who wrote it should be reported to the TPWD office in Austin.

The only length requirement relating to spikes is the length of any points that would make it a "branched" antler. If the point is one-inch or more, as measured from the edge of the main beam (rather than the centerline of the main beam), it is considered a branched antler and not a spike.

I'm sorry was just told there was no citation given, the warden took the bow and the deer. The warden said it was an illegal deer because it wasn't 4 inches in length and also wanted to test to make sure it was shot with an arrow...

hmm... the plot thickens.

there is no rule for length of a spike. Sounds like he doesn't think it was shot with a bow, and the 4" deal was a comment made that your buddy is hanging on to

this should be a straight forward game law the warden should know, however I have found with wardens on both fish & game that they have to know all rules for all game and its overwhelming. especially if they are new, sometimes an experienced hunter that specializes in one game knows more than the warden and nicely pulling out the rules and pointing things out goes a long way. kinda like CHL holders know CHL laws better than many LEO.

Man sounds like your buddy got jacked...you sure this guy was even a Game Warden??? there is no such law and surely there is no warden who thinks there is...did he write a warning??? Or did he get a name???I wouldnt be suprised if you called in his name and he didnt even exist

Only length rule I remember is the spike has to be atleast 3/4" or is not a spike but antlerless. As long as it is not branched, its a spike.

...and why I ALWAYS KEEP A COPY OF THE TP&W GAME LAWS HANDBOOK ON ME WHENEVER I AM IN THE FIELD OR HAVE POSSESION OF FRESH KILLED GAME EVEN IN THE TRUCK... it keeps it more simple that way if I have to call the 24/7 TP&W Hotline ...I also have a 24/7 access card to to talk to an attorney from anywhere in the US or Canada on me at all times as well...the other side of that card is a printed notice that informs a Law Enforcement Officer that I am asking to be allowed to call my attorney concerning my detainment or interrogation.

Somewhere on the ticket the Issueing Officer will have to sign and state his badge number...

I call BS on this deal ....as it is being reported.

WE NEED TO KNOW FOR DEAD SOLID AND FOR CERTAIN WHAT COUNTY THIS HAPPENED IN...and who the Issuing Officer was by agency, full name and Badge Number.

I suspect that your buddy has his facts crossed. GW's don't take deer and weapons without a legitimate reason. The 4" spike story doesn't sound legitimate to me all since there is no law requiring it.

Maybe there's something that your buddy isn't telling you. Or maybe he honestly misunderstood what the GW told him. Easy way to clear the air is for your buddy to call the GW or his supervisor and inquire.

They sure dont take any hunters guns or equipment without writing a citation and explain the info that the hunter has a right to know on whats gona happen with the case and also what will happen to his stuff and how he can get it back...if he is allowed to get it back...

im willing to bet something wrong was done and the buddy doesnt want to own up to it.i hope not though. if it was an imposture game warden this guy had some big ones for sure! to the OP do you have anymore of the story?
