Unfortunately, this thread and others are a reflection of what our society has become. We are high on entitlement and low on respect.
Tresspassing can be justified, if there is personal gain to be had. People are entitled to all lands, if they've been there before and claim it as "their spot." Someone asks for advise on how to improve his current practices...insult him.
There was a time when our sport was thought to teach the same values that are being driven to the ground by some of our posters. We could work on turning that around or continue to feed it.

This is not a question to start debate, it is a seriuos legal question because I do not know the answer. If he had not taken an animal from the land, eventhough its obvious of his intentions, is he still a poacher or just trespassing?

Laws only apply to the honest people in the world. I guess the guy will one day get what he deserves... if not lucky and good for him. As for me not my thing I don't feel the need to go onto someone's private property to steal and yes that's what poaching is stealing. Dude got lucky next time if there is one I will catch him and hes going to get to explain to a judge why he felt that he could be there.
oh and we put out around 15 cams today

Yeah if its dark out and I come across somebody on my place with a loaded weapon in their hand that shouldn't be there I don't think worrying about what the law is going to do with him is going to be a the top of my list.

My Mother lives in South East Kansas. Every year we have to run people off. KS has BIG BUCKS. She said she ran a guy off alread this year. I'm going up for 3 days this year. I'm hoping I can keep people off our land long enough to tag a deer. I've had them just drive up while I was hunting, and one guy came flying in threw the gate. It was the cattle owners son. Said he though he shot one from a couple of houses over. I was pissed to say the least.

LEOs are held to a different standard than citizens. Citizens may use force to protect themselves from forceful property loss i.e. breaking in to my occupied home. See Castle Doctrine.
I didn't say I would use deadly the force in the case of the poacher/tresspass. I said I would take an armed person walking toward me on my property to be a danger. Would you suggest I wait for him to shoot me before I take offense?
Plain and simple, don't enter someone's property armed and expect to make lifelong friends. I have not intention of shooting idiots. Ammo prices are way too high and might have to turn the gun on myself many days. Not sure, but I think asartor might have been misunderstood on his post for this thread Or the guys on the other thread managed to change his mind

  too those advocating to not wander around in the dark, shooting into the dark at a shadow is poor gun discipline. wanting to kill a man because he is guilty of killing animals god put on this earth to 1 make the earth go round and 2 for man to eat is pathetic.

Poachers are rats, worthless. IF you can't afford your own place to hunt, then don't hunt. I would like a Ferrari, but can't afford it. So if I was like a poacher I should just go take it.
Once a year game warden finds a poacher near our land it seems.

I am not up for shooting anyone just for being on my place. That is what GWs are for, to deal with the law breakers. On the other hand, if I am at my stand and a shot is fired at an animal under my feeder, I cannot speak for what the rage might do and I say this for 1 reason.
He took no respect for the life of me, my son, or my father that might have been setting in the blind in some direction from that feeder.(I hunt mostly from popup ground blinds). No matter how much they "need" the meat to eat, there is no reason they need to steal it from me or my neighbors. If they "need" meat, ask me to shoot a hog for them, I will donate all they want, but don't steal it from me at the possible expense of my life or a life of my family members.

Its the maggots who drive around looking for a quick place to sneak a hunt in, is the ones I have a problem with. The vast majority of my hunting grounds is what I lease. I work hard to have it.
