From game warden field notes • On Dec. 3, Upshur County Game Warden David Pellizzari received an Operation Game Thief tip about a subject who had supposedly killed 10 deer throughout the past year.
Upon investigation, Warden Pellizzari noticed a small set of antlers hanging above a pool of fresh blood.
When asked how many deer the subject had killed this year, he responded by asking what the limit was.
A check of the subject's license showed only one tag missing.
The subject told the warden that he carried that tag in his pocket in case he was caught by a warden, and that he had never tagged a deer in his life.
After several hours of questioning and a search of the property, Warden Pellizzari learned that the subject had killed nine deer this year including one 13-inch buck, one 11-inch buck, three button bucks, and four doe. All four doe were killed before legal doe days, and two of those were killed with a .22 Magnum, a firearm illegal to use for hunting deer.
Numerous charges ranging from over annual bag limit to illegal means and methods were filed, as well as civil restitution for the illegally taken deer.
A large amount of venison was seized and donated.

All i can say is dang! Glad they caught him but im in hopkins co. but that dont mean i dont have the same problem. I hate poachers! I dont even like the 4 deer bag limit we have in place now. 10 deer is ridiculus.

That sort of thing used to be real common around Ranger. Some folks killed deer and caught fish to eat year round. That's pretty much the only meat they had. Limits or laws didn't matter. Fortunately it seems to be fading away as the folks with that mindset pass on and the penalties have become so harsh that it's just not worth the risk.

Ya know i wouldnt have a problem if somebody needs a little meat but 10 deer is way overboard!

He probably been doing that for years before he got caught!!! The scary part is he probably knows others that are doing the same thing. After all what do you do with that many deer? Hamburger joint maybe? Ground up and mixed with some beef it's hard to tell the difference!
Thursday at 12:45 PM #33 Once i learned that i didn't "NEED" to kill something, and that if i did kill something all the fun stopped and work began, i was a much better hunter.

Im glad they caught that low life. In all of these GW stories the suspects always confess to the crime and sometimes numerous other ones. Why dont these guys keep their mouths shut and call a lawyer. Glad they dont though. I guess they're stupid for committing the act and stupid to admit to it.

I was once told that game violations have the highest conviction and payment rate of any crime. Seems that most guys are so ashamed at being caught that they quietly show up to their court date and pay the fine rather than fight it because they don't want anyone else to find out what they did. Also heard about a fish poacher that regularly carried his fine with him in his overall pocket. When the warden caught him, they'd call a JP, and he would just hand over the money - said it was part of the cost of doing business for him.
Then again, I've also heard of JP and county judges in some rural areas that refused to do anything about game violations - they thought it was not a "real" crime. They might be forced to sentence a violator, but would never get around to collecting the fine or really punishing the person.

If he needed meat there are probably lots of pigs in that area that he could hunt. I understand that people have to eat. There are other ways, but I don't think he did it because he had to eat. Glad they caught him.

Game violations, by nature, require a lot of evidence to even get the ticket to begin with. There's really not much you can do to dispute being in possession of illegal game, and wardens use video cameras to record you in the act a lot.
I know that because it happened to a friend of mine who is a defense attorney. He didn't even fight on his own behalf because right off the bat the evidence was overwhelming when he saw the tape (shot some non-game bird out of frustration one morning when ducks weren't flying in case anyone is wondering).
1. Warden walks up and issues citation on dead bird floating in pond. 2. Lawyer buddy starts his lawyer speal..."How could you possibly know that this bird didn't die of natural causes or wasn't killed by someone else before I got here?" 3. "Because I saw you shoot it." 4. Oh, really? Well, I don't think you... 5. "Here's a video of you shooting it." 6. "...Oh..."
