My contract is still a hand shake between friends it's alot less to deal with. He hunts there and his family no matter what the paper says they will hunt period you can draw it up all you want they will do what they want on their land. That's the problem with todays hunting everyone want a contract I know the money is alot higher today but the paper is useless may as well keep it easy b/c the more you Bit_H the faster you will go come contract time.

Had basically the same thing happen to use in Mason Co. The owner died and grandkids got the land. Everything was good for a couple of years, then they came up with some crazy harvest rules- 1700 acres, 10 good bucks and the rst spikes and does! Happened to come in a day early towards bthe end of the season and found a grandson and couple of friends "hog hunting". Didn't sit well with us, then the called the next March and said everything needed to be off in two weeks. Great lease, but they had more ideas than money
I'd ask him if he's pregnant. He missed a s__tload of periods. I'll take "things that look like a uterus" for $200 Alex.

I have been on both sides of this equation, first as a hunter and now as a landowner. I think my time as a hunter and dealing with the fickle nature of landowners has helped me to be a better one now.
My experience was that landowners wanted your money but never really wanted you on their place. Essentially wanted to have their cake and eat it too. This was not all but certainly the majority.
That said. I lease my place now and would not even hunt it myself much less let my family or anyone else hunt it. The hunters paid for the hunting rights and so in my mind are the only people entitled to those rights. I own(or at least the bank does) everything about that piece of property, except for the hunting rights. I leased those out. I am sure I could have worked it out where I could hunt but I had rather just lease a place with friends to get my fix.

If all parties are agreeable and everything is above board from the get go then it's not a problem. What I'm talking about is when landowners spring it on you half way through the season. It's not right. If you were lead to believe that you had exclusive rights only to find out later that it's a lie then anybody would be upset by it. Full disclosure and honesty from the beginning goes a long long way.

The reallity of the situation is that it will always be a double edged sword. A signed contract for hunting rights is a legally binding agreement just the same as if you were leasing an apartment. The landowner gave up his rights for money. As long as you are not breaking the rules he shouldn't be either. That being said when lease renewal time comes he has every right to send you down the road. I don't have lease this year because the landowner kept changing the rules in an agreement he drew up all by himself. At first it was a handshake deal but, he wanted to put it all in writing to protect us. I think he was getting into the first stages of alzheimers and it made it very difficult to deal with the whole lease so we left. I would hope that as grown men any landowner and I could work out this situation to the benefit of us all (i.e. if he wants to hunt give us a break on the price next season, help with feed etc.). Communication is the key. It is his land but he is the one that decides to turn it into a buisness proposition

I own some land here in Texas. I went out to "my" place last month and there was a guy in a suit sitting in my tree stand. I said "Who are you?" He said his name was Joe Thomas. I asked him what he was doing and he said he was hunting. I asked him why was he hunting on "my" land. He said he was with First National Bank. (That bank holds the "title", mortgage to the property.) I said "Oh, okay, I will go hunt a different stand." I wished him good luck as I left.
I went out to "my" place again last week and there was quite a few guys in suits, ... this time sitting outside my trailer, (the trailer door was wide open), drinking beer, cooking some brauts, munching on chips. I said "What are you all doing here?" They said they were just having a good ole time. I asked them why they were on "my" land. They said they were with First National Bank. As long as you are not breaking the rules he shouldn't be either. Unless it explicitly states that your use of the land to hunt is exclusive, this isn't right. Apartment rentals contain exlusivity clauses.

That is a valid point. According to my info it could also be argued that if a landowner didn't specify, in the contract, that he would be using the property for the same activity as the lessee he has leased the rights to, he has signed away those rights. I suppose it will come down someday to a court battle and then we will all know on what side the law will stand (probably the landowner)
