Probable cause though is an easy thing to show on any paper work. Trust me I know and you can ask ant LEO that. Well i guess I am puting faith in LEO Integrity and hope he is not making up his probable cause. But as stated before the game warden has lots of useful information and is always welcome on my property.

I'm not saying they make things up it is just easy to come up with probable cause. They and any LEO are more then welcome to check anything of mine also.

The one I was always curious about was coming on private property. If you have a locked gate, can they jump over if they know you are hunting or do they need to wait at the gate unless they have reason to expect a law has been broken? They need a reason. I have seen a GW ran off a ranch one time it was  . The GW told the land owner what are you doing the land owner said you are on my land who the H### do you think you are. He said I am the local GW. To make a long story short the GW was escorted off the property and told do not come back. yea, not sure i believe that either...GW's can come on your property with only probable cause. they can also search your residence, vehicle, etc without a warrant. I will occasionally hunt with one of the GW's in East Texas, some of his stories are pretty crazy.
Is it duck season yet?

The GW around my place has the code to my gate. He checks on it when I am not around. He is a good friend. I am not trying to make fun of them. I am just telling you. You do not have to bend over for any law. If they are doing something wrong you have the right to tell them. If you have done nothing wrong what can they do to you? I was in law enforcement at one time you see good ones and bad ones. I got out because the pay sucks for what you deal with.

We have developed many myths about Game Wardens powers so much that some Game Wardens believe them. SUBCHAPTER B. ENFORCEMENT POWERS http://law.justia.com/texas/codes/2005/pw/002.00.000012.00.html(c) Except as provided by Subsection (d), a game warden or other peace officer commissioned by the department may inspect any wildlife resource that has been taken by a person and is in plain view of the game warden or other peace officer. (d) Nothing in this section authorizes a game warden or other peace officer commissioned by the department to conduct a search otherwise authorized by this section: (1) in a person's residence or temporary residence; or (2) on a publicly maintained road or way that is: (A) improved, designed, or ordinarily used for vehicular traffic; (B) open to the public; and (C) distinguishable from a shoulder, berm, or other area not intended for vehicular traffic. click and read

The Constitution does not give that power to anyone. Not sayin they won't, not saying they won't get away with it 9 times out of 10. But it is still against the Constitution. All that being said I do not think I have ever had an unpleasant dealing with a GW. You obey the rules you have nothing to worry about. As for the original question I would ask a lawyer how to handle the situation if you do not like him on your private property. The deer lease I am on, The same guys have been on it 17 years. Seen him one time, he came in checked em out then left. Game Wardens leave notes for their replacements, they think someone is trouble. The new Law will know too.

Probable cause is not needed to enter property. A landowner cannot escort a GW off the property. Sec. 12.103. ENTERING LAND; USE OF INFORMATION OBTAINED BY ENTRY; CIVIL PENALTY. (a) To enforce the game and fish laws of the state and to conduct scientific investigations and research regarding wild game or fish, an authorized employee of the department may enter on any land or water where wild game or fish are known to range or stray. No action may be sustained against an employee of the department to prevent his entering on land or water when acting in his official capacity as described by this subsection. we used to get checked on a regular basis goose huntin and the GW would hit the deck if birds where comming. good guy... I once asked if he wanted to stick around and help us pick up the spread and he declined

As usual, Robbf has it corrected for us.
On the few places that are locked, our game wardens have the combo. They are welcome anytime, anyplace. In fact, I wish they came around more often and there were more of them.

Didn't do anything wrong just after the fact some things seemed weird. He did do some hiking though and don't really know how he found us. I think he was tracking some punks that we flashed off but moved 25 yds away. I think they were unliscensed cause they high tailed it. He heard us shoot then came over. Checked us out and all was good. Just thought it weird considering he asked for guns yet never identified himself other than the uniform. Easy way for an imposter to create an unsafe scenario. He did spoil the hunt for about 15 min though. Oh well we checked out and didn't really see anymore birds.

Just found out my GW in the Freer area is my cousin (on my wifes side). I spoke to him a week or so ago and invited him over for a steak dinner this Saturday night around the campfire. Not sure if he'll show, but I'll have a steal ready to cook for him. Since I'm new to that area (been hunting in Junction for the past 20 years) I had a lot of questions for him. GREAT guy.
In Junction, the GW for that area was great...his replacement, not so much. Our motto is, just stay legal, show respect and do what they ask and all is well. The one in Junction used to sit and drink coffee with us...man did he have some stories. SOME that would rival the Darwin top tens...without the death...
