i'm trading my Marlin .22mag rifle w/ Nikon ProStaff scope for a Walther P22 from another board bro...but he's a bit worried about shipping it to me. basically looking for a middle man. i could please ship my rifle to u...u, in turn hand it over to him...and then ship the P22 to me once its all done w/...we'd really appreciate it...he will cover the shipping cost. let me know on the thread so we can keep this open to the public...dont want to keep this private from anyone involved. thanks in advance.

I am thinking it is just that you can not mail handguns without a dealer. Ups and Fedex are ok. So I understand.

i'm shipping my glock g22 .40cal out tomorrow...in an exchange for a springfield xd...have never had a problem w/ it. as far as i'm concerned and been advised...as long as its shipped inside state lines.

Kind of obscure, some people say it's ok as long as it's overnight via certain carriers. However I found this. Sec. 46.05. PROHIBITED WEAPONS. (a) A person commits an offense if he intentionally or knowingly possesses, manufactures, transports, repairs, or sells: (1) an explosive weapon; (2) a machine gun; (3) a short-barrel firearm; (4) a firearm silencer; (5) a switchblade knife; (6) knuckles; (7) armor-piercing ammunition; (8) a chemical dispensing device; or (9) a zip gun. at this link http://www.statutes.legis.state.tx.us/Docs/PE/htm/PE.46.htm#46.06So that's enough to convince me.

Well, I thought it was, then I read the Definitions portion at the top
(10) "Short-barrel firearm" means a rifle with a barrel length of less than 16 inches or a shotgun with a barrel length of less than 18 inches, or any weapon made from a shotgun or rifle if, as altered, it has an overall length of less than 26 inches.
so go for it??

you cannot ship a handgun in the state of texas without an FFL
call the ATF and the sherrifs department if you dont believe us

I think I beat you to the punch on correcting myself. I was under the impression that a short barreled firearm was a Handgun. Apparently not.

You're probably not going to find a random individual to act as an intermediary- just use your nearest FFL and that way everybody will have that peaceful easy feeling that Bob's always singing about...
But as to the issue of shipping, as long as you can both legally posess a firearm, you may ship it INTRAstate. The only time an FFL is needed is when crossing state lines, that's from the mouth of the agency that represents my 3 favorite things, Alcohol, Tobacco, and Firearms...

Agreed. I've thought for a while now that handguns are illegal to ship. After reading the link above and THEN going to ATF's website, which references TX law (at see above link), I'm pretty confident in saying that it is legal to ship handguns IAW TX law.
Please if anyone thinks different, post a link or something with .gov or .us that says otherwise.
live4perfection-sorry your thread got jacked but on another note, thanks for getting me motivated to actually do some checking into the subject.

im not doubting cause i do not know for sure, so unless somebody can post a law that specifically says handgun, i wont dream of taking the risk

thats cool Tetra...as long as we get to the bottom of this...so for the record...dont ship a handgun through United States Postal Office/Service...only through FedEx, UPS, or DHL (if they're still around)!

Given that the question deals with what a nonlicensee MAY do, I don't see why they would mention handguns if a nonlicensee weren't allowed to ship them...

This is how the law works. The law doesn't list all of the things you are allowed to do. It generally only has to do the with the things that you can't do. If you can't find anywhere that it states that it is illegal to ship a handgun, then no law exists as such, therefore the legality of it is not a question.
