Went hunting south of San Antonio on a small property (177 acres) that is low fence with a high fence on the west and part of the south sides. Don't know if you've been down in that area or not but there are tons of high fences all down the high ways. The land owner told his son-in-law (who I went with) that they have been seeing two ear tagged bucks on their place most of the season. One was a big 10pt. and the other a big 12pt. Apparent escapees of someones high fence. The owner told his son-in-law that he didn't shot them cause he wanted them to breed his does. Remember this is middle of January and the rut should be over and there are two trophy class ear tagged bucks running around. Question is "Would you shot one if you saw it?"
Another question is "Would you consider these deer tame or wild???

IMO escapees are no longer the high fenced ranch's property because these are not considered livestock, and yes I would shoot one if given the opportunity on my own land.

If (i) it's deer season and (ii) they're on my property, that deer is fair game.

If the landowner asked me not to shoot them, I wouldn't. If you hunt his land, you respect his rules regardless of whether you agree or not.
If they don't come up to you when you shake a can of corn, they're wild.

I did not read carefully enough. I'd also go with the landowner's wishes.
But my above comment stands on your land. If a deer is on your land during deer season, that puppy is fair game.
But I'm gonna be a diamond someday

Of course we didn't even see either deer but we were having trouble deciding should we do as the owner wanted or would it be too tempting to resists? Kinda glad we didn't see them cause I still don't know what I would have done. Any way I have an invitation for next year to hunt again. That's what I really wanted.

So if one of my cows get out and is spotted on your place does that mean it's no longer mine? This a pretty good question. I'm not real familiar with hi-fence operation, but if i purchased that deer and put him behind a hi-fence and he gets out, i believe he would still legally belong to me.

they belong to the state. fair game. i wouldnt do it if the landowner didnt want me to. but otherwise yes.

i am afraid if they are whitetail they do belong to the state. if i hit the tagged deer in my car can i sue the owner? no if i hit a cow can i sue the owner? yes

Nope, i would respect the land owners wishes....No if's, and's, but's bout it. You are a guest on his property and if I were him, I would want to breed them as well. Be glad you didnt shoot one, or I am sure you would have heard an earful from the LO

I wouldn't shoot it. It being tagged would lead me to believe the deer was actually purchased and belonged to someone else.

You are real lucky you did'nt see the bucks because if you can't say "you'd pass" without seeing them. It only means you probably would take one if you saw it.
A good rule to remember is that THE LAND-OWNER'S THOUGHTS, TRUMP YOUR IDEA 100% OF THE TIME !!!!!
We as hunters need to learn that without land-owners on our side, hunting could be finished "as we know it". There are already to many factors working against us, for us to squander the few friends of our sport we have !!!!!

you cant sue the owner cause texas owns them. we need a third party here to tell him that texas owns all the whitetail deer.

Sorry to chime in on your discussion HWY_MAN, but what you think of as a purchase is actually just a transfer fee to move a deer from one part of the state to another. You cannot own white-tail deer in the State of Texas, they are classified as wildlife.
Hope you understand now. Just giving you the facts.

I looked at your link HWY_MAN, do you understand it is the same as buying a hunting lease. Your just buying the right to get good bloodlines on your land, not the actual deer to own.
The best way I can say it is that, you pay those guys on the above link to get good deer on your land, but when you shoot one of them, you better do it in white-tail season and put a Texas State white-tail deer tag on it or you'll be paying a big fine to the State of Texas.
