This is exactly why we have constitutional rights. You may not abuse this unconstitutional law, but others can and sometimes do. So, while we won’t assume all cops are up to no good, it’s best that nobody assumes that a few aren’t.

I suppose if you'd simply watch the video, you'd understand why folks here are resistant to buy your position - it's what we have to go on in this thread...as you attempt to convince us laymen of the righteousness of CAV without having watched the video, you don't appear to get what has everybody fuming...if you do go see the vid and then don't agree with what happened, you will realize that you seem to be arguing against your own position...

Yes, the point is this little thing called "innocent until PROVEN guilty". Civil asset forfeiture bypasses due process, trial, etc. and places the burden on the accused to recover their property.


Ok so they go to jail and get a bond (which is based on several factors and not considered punishment) and come to trial and I come to trial and I bring my evidence and report which states why I did what I did and I prove they’re guilty.


That's for the criminal matters. CIVIL asset forfeiture is not a criminal matter, and so the defendant does not get an attorney provided for them, etc

This boils down to a simple concept: If a crime is suspected make an arrest. It's the "civil" part that becomes problematic.

Yep. Anytime I’ve tried to get law enforcement involved in a civil matter, they won’t have anything to do with it. But in this case, it’s game on.

Right. If I get stopped while carrying a large amount of cash, then arrest me, charge me with a crime, and impound the cash as evidence for the trial.

Back when I scuba dives in Mexico, the dive master had a locked briefcase with $20,000.00 in it in case someone had to be evacuated back to the United States. He also had a letter from the bank, the air ambulance company and the hospital you would be flown to. He declared it leaving the US and on re-entry without any trouble.
PS: As a diver, we were expected to write him a check, before he paid the air ambulance company. I had the check already made out except for the signature. The group I dove with made sure we did our decompression stops by the book (or stop watch) as we were the first in the water and the last out. We sometimes exceeded the limits, due to folks not understanding, ARE YOU READY to dive.

To keep the TSA inspectors from knowing about it. There is no telling how many millions or billions of dollars that go through the baggage on airlines. The money is most likely from something illegal, she may not have even knew it was there.
