You are talking about people you have chosen to live outside the law needing protection of the law. If the prisons were harsh enough, it would be a behavior altering experience for those who are eventually released. Let them reap what they sow.

We used to have that up until the mid to late 1980s in Texas and the "System" produced murderous psychos because the skill set needed to survive in that environment made people unsuitable for life in the free world. When that ended in Texas the completely self funded prison system that we had for nearly 80 years ended at the sametime. Read the Ruiz v. Estelle lawsuit and you will understand what I am talking about. I am familiar with it because the Judge on the case was a family friend and I spoke with him about it at length.

I do agree that prison should be harsher then they are but I think running them like a boot camp instead of the lord of the flies would serve society better.

Although I agreed with him being held accountable for what he did; the government failed to keep him safe. The Warden needs to take his place in a cell. He failed to do his job. Without accountability, this was expected all along. No surprise.

Once any person becomes a ward of the Justice Systems incarceration programs the Government whether it be local, state, or federal are responsible for the health and well being of each person. In this case almost all the factors determining protective custody were met. The individual can refuse it but ultimately it is left to the highest authority in each institution. Almost always they err to the safe side because of litigation. He has a very good case if he was never offered. If he has refused the highest authority should have still placed him there until a court order released the authority and the court took responsibility. He will win a suit he goes this way.

Wouldn't surprise me if this man was set up to be killed through deliberate negligence. It would be very very inconvenient for his conviction to be overturned from the perspective of quite a few people in government and as long as he is alive that possibility exist.
