Remind him that if he takes it to court the judge will want to see his lease license from last year. I bet a guy like that didn't bother to get one. Tell him he'll pay fines for that. Also tell him you contacted a lawyer and without a written contract he has no leg to stand on. Of course say it all with lots of conviction.

I bet a guy like that didn't bother to get one. Most don't, every lease I've been involved with, the deal was done in cash and a handshake.

I can't believe he would even think about going through with this without anything in writing.
I have hunters from the previous 2 years that will give written statements if it comes down to it.
They were all very unhappy that they didn't get what was promised to them.
Running a good lease is impossible when you have to go out and find new hunters every year.....that is what I hated most about it.

I'd tell him to get going on what ever he wanted to do, because he is the one who broke the agreement! If he had shreded there would have been no problem, so the problem that exists today is his problem, PERIOD! If that didn't get him off my back I kick the crap out of him,if he came to my office raising hell. But what ever I would never hunt on his property again at any price! This has always been my problem with hunting in my own home state. The ranchers are always bitching about something, and wanting to change horses in mid stream. It is uncommon to have a real written agreement with these A-holes because if there were he couldn't hold you hostage, and he knows it, like they almost always do sooner or later. In most cases a rancher's word in a word of mouth agreement is worth nothing if he sees a way to make a little more money off the lease! I would like to see a law passed that you couldn't lease property for hunting without a notorized agreement filed in the county courthouse, with certified copies for each party! That would stop all this crap once and for all! You'll never see that though, because then neither could crawfish on the deal.

Tx, not trying to scare you but a handshake is a "contract" or agreement. Before you do anything else talk to someone who really knows about situations like this. Just a word of caution. He could be within his rights. We had a similar situation where we as leasees had to eject one guy off the lease and he threatened to sue for breach of contract, (handshake), and the only thing that saved us was.... it was a contract but only an annual one. Guess who didn't get a new "contract"?

So have you already paid him the $3500 for this season?

Landowners by and large are solid, honest people. That said, there are some I wouldn't walk across the street to pee on if they were on fire. To me, a handshake is as binding as a contract, but not all see it that way. Walk away without a further thought.

poor character on behalf of the land owner. for all you know he may tell the judge he raised his fee to 10 grand but its not in writing. i suspect even without anything in writing you all will have to mediate. that still sucks though.
