Not to mention multiple times of failing to follow commands. It is all a test from beginning to end and she failed. And now so did he.

I've conducted many DWI's earlier in my career. I could not see her eyes but I have no doubt the officer saw the clues she was looking for. As far as the rest of the task she was asked to conduct, my observation was that she failed them. Based on the totality of circumstances I would have done the same as this officer. I've used the portable breath tester and she definitely did not follow the instructions as needed to get an accurate result. As far as Mr. West calling out DPD for leaving the kid alone was total malarkey. That DPD Sgt. was there the whole time. Mr. West lost all respect I had for him after this incident. Sure hope DPD stays strong and continues to back this officer.

She didn't seem drunk, but she didn't seem fit to drive a car either so kudos to the officer.

Testing someone 3 days later is irrelevant, providing her liver still works.

My money is on no alcohol in her system. Cop clearly struggled to give the sobriety test including referring to a cheat sheet and was obviously unfamiliar with the procedure. I didn't see anything in the video that indicated she was drunk, and I bet she blew a zero on the breathalyzer. If all of those things are true I'd be pissed too if I was him.

Why in the hell is the breathalyzer test not the first thing given? This is 2021....is following a pen with your eyes and walking in an imaginary line the best option we have for detecting sobriety?

The officer tried to use a handheld PBT (Portable Breath Test) but she wouldn't blow into it correctly for it to get a reading. I read the search warrant and she initially consented to a blood draw and then refused at the hospital.

Her guilt or innocence is no longer a consideration. Probable cause existed to arrest and collect blood. This will be hammered out in hearings. My bet is the DA drops the case anyway.

She left northpark heading to lake highlands and drove west (the wrong direction) for 15 minutes and was stopped at 35 and Northwest Hwy.

Yes, those tests are still the best we have. The HGN (eye test) alone will give the officer a very good idea of the person's level of impairment. If the officer sees all 6 possible clues, the likelihood that the person is over .08 BAC is ~90% without doing any more tests. If he/she sees vertical nystagmus in the eyes the percentage goes up more. The other tests are designed to be divided attention tasks to mimic what is required to safely operate a vehicle. They have been standardized and accepted in court for many years.

The eye test is objective. It's not checking if you can follow the pen, it is whether your eyes track smoothly or jerk. You can't feel it, but when you're drunk, they jerk.

There are a lot of people who pass SFST's so they are screened out of the intoxilyzer step by that. The intoxilyzer is done post arrest (at least for us) so probable cause for arrest has to be developed first. That is done with the officer's observations and SFST's if the person doesn't refuse them. As far as the PBT (portable breath tester), we quit using them on DWI arrests years ago because of a court case that decided if the person consents to a PBT on the side of the road, which is not admissible in court, and then refuses the actual intoxilyzer test, we can't consider that an official refusal.

Not defending her at all, but I have had a GPS send me to the wrong side of Tyler, Tx when we were trying to return a U-Haul trailer. Seemed no matter which place you picked, it sent you to the one on the west side of Tyler. I can't count the number of people that have had GPS's try to send them into an empty field or a lake.
As for her getting pulled over, the story keeps changing. First it was she didn't signal a lane change, then it was she couldn't drive in a single lane (video showed that), now they smelled alcohol in her vehicle. I am very much PRO Law Enforcement and will wait till the blood work comes back before I even think about making a decision on her guilt or innocence. I also agree her husband should have stayed out of it till he had all of the CORRECT facts.
