If they were staring at birds in the sky, then no one would have an issue. The problem lies in the fact that they are looking down, possibly taking photo/video of the ground which IS owned by others. You wouldn't be able to stand on a public sidewalk and use a pair of binoculars or camera to invade someone's privacy through their home window. I don't know what the laws are, but in my eyes it is invasion of privacy.
