Im not getting your point. So if you get a call about a man just driving his vehicle (nothing illegal about it), you go and pull the man over because yall got a call about him doing something that is perfectly legal? That doesn't sound screwed up to you?

And the call was not that the man was shooting in the street, or waving his gun around. All he was doing was walking down the street with one on his hip.
Since I dont have a clue what the calling party told dispatch I cant answer that. But if someone calls the police on a matter that isnt a crime chances are the police will not show up. Tons of people make stuff up in order to get the cops to go or to go faster. If someone in Texas is walking down the street with a rifle (legal) the police will show up, and thats not a crime. I'd just walk up and talk to the guy and if all seems fine then I'd leave. If he was intoxicated or had other issues then there would be more to it. But to your question if a call came in about a man driving down the road doing nothing wrong I'd laugh and go about my business.

I think it's funny that the same people who want to build a border fence and put hundreds more agents on the border have such a problem with checkpoints. Fiscally they're much more cost effective.


understanding that these check points are not on the border, but 30-50 miles away from it.

Damned if you do ... damned if you don't. We have a problem on our southern borders with illegals and drugs. The checkpoints are an effort to try and combat the situation. I go through those security check stations pretty often while fishing Falcon and Amistad and have always found the agents to be easy to deal with. I don't mind being asked if I am a US citizen, but I also don't believe it is unreasonable to have to present a photo ID when you are voting.

Are the check points any less legal than a DWI sting on New Year's Eve?

Neither are illegal. But they do rely on voluntary cooperation and consent as you can see. Because most people freely give it, they work. But, when people choose to stand on their rights (i.e. no reasonable suspicion to detain or probable cause to arrest) then LE is required let people go about their business. It's just our Constitutional republic in action.

Many DWI checkpoints now have a judge either there or available by phone so warrants for a blood draw can be issued on the spot for those who refuse a breathalyzer or the field sobriety tests. But, again, the officer must articulate probable cause for the warrant.

What most do not realize is that the checkpoints are in very remote areas in most cases or just outside of Border Towns where
the traffic can be isolated..I've seen the around Sierra Blanca,
Encinal, Miranda City, ect..There are so many ways into our Country in rural areas that the law enforcement has to get where they can do the most good..We got stopped Dove hunting one yr on
a dirt side road on Baylor Ranch near Sierra Blanca, BP thought we were trying to run the roadblock, never realized we were hunting and looking for varmits ect..thank goodness on private prop..as we did have some BEER..DD

This kid did exactly what all citizens SHOULD do. Maybe it was staged, but it serves a valuable purpose - showing common citizens that they DO have rights and do NOT have to submit to law enforcement officers if they know they are within their rights and have broken no laws. A police officer MUST have PC (probable cause) to detain you, which is exactly why the kid was asking the officer "Do you believe I have committed a crime?". If the answer is "No" then, legally you are free to go and the LEO has no right to continue questioning you.

4. In public
5. While intoxicated.

Sec 49.04 (I think ) of the Texas Penal Code.

I went to show a friend the op's video, and for some reason, on 3 different computers, it says there is any error loading, yet other unrelated videos play fine. Did someone higher up get ahold of them?

The guy in the video has all kind of videos about being drunk on a lawn mower and getting arrested. He's even got one stealing a squad car and another one getting arrested driving a scissor lift down the road. His name is Steve the lawnmower guy.
