while the guy did kind of come off as a bit rude, he sure did know his stuff. my 8 yr old son just asked me what i was watching, and i explained it to him. He said "but he should listen and do what the cop says" but when i explained that he did nothing wrong, and had no right to be stopped he understood. there are a lot of videos like this online. When I traveled to NM last summer, i researched and even called local police about open carry. I attempted to open carry one time when i was there, simply because my attire did not allow for concealment. I was given all kinds of dirty looks by locals, and not one time in eleven days in the state did i see another person open carrying. when a police officer looked my direction while getting into my vehicle i decided i did not want any confromtations in front of my children and decided not to carry any more while there.
funny how in states where open carry is legal, it is still frowned upon.

Good for him! I was once pulled over for a broken headlight. Cop asked if he could search my truck. I asked him what was his probable cause and he said he didn't have one. I refused and he let me go with a warning.

What ever happened to respect for the badge, if I saw a guy walking around my neighborhood with a gun, I would call the police as well. Just because this "moron" thinks he knows all his law books does not give him the right to be blatently disrespectful and in a sense, incite the very thing that is happening to him. He is "suspect" of being a dumb arse in my book. JM 2 Cents. realmad popcorn

I don't think asserting your rights is being disrespectful. He simply refused to give the police the info they were illegally requesting from him. He may have come off as a little rude, but I didn't see it as disrespect.

I wouldn't consent to a search just for the sake of being "respectful."

However, if the cop was calm, collected and respectful to me, I personally would have let him check my ID and then been on my way. Probably would have been quicker than the time it took for him to go through all of that.

exactly....he was exercising his legal right to open carry. we all know what happens to rights that we do not exercise. not illegal = no reason to stop and question. period.

This kid is a punk and it shows, he was droping case law way too much to know anything about the gun itself. He had an agenda and that was to make a youtube video. Just like someone said if you open carry people are going to call. Say 20 folks call cops say there is a guy walking down the street with a gun on his hip and the cops say we cant do anything it his right. Then this same guy steps into a school and shoots ten kids. Even if case law saws its leagal, stopping the guy making a little conversation and seding him on his way may deter some stupid act, hard to say but not checking at all is way too trusting of some nutty people in this world.

when he acts like he did will do nothing more than get into the heads of the city leaders and make it illeagal to open carry in certain areas. a little cooperation goes a long way

If the guy had been a "nut" case and was going somewhere to kill a few people the comments would be totally different. Then the blame would be placed on the LEO for not stopping him. Damned if they do and damned if they don't.

You are calling him a moron because he is asserting his RIGHTS? not a privilege like driving...a RIGHT. I WAS LEO for 16 yrs. I know on which side I am on....the rights of the people. Many of my partners would get away with a lot because People generally are submissive toward Law enforcement regardless of their rights.

i'm not trying to start an argument, but i don't think that's a valid argument. the guy wasn't a nut case... wasn't doing anything wrong. so let's say the guy was a legal concealed carrier, and the cop just stopped him to see if he was carrying concealed, is that ok? if someone gets pulled over for no reason at all, breaking no laws driving, can an officer just pull them over because their car is "flashy"... is that ok? absolutely not. it's profiling. the officer responded to a call of a man with a gun... posing no threat... profiled him as a criminal in order to stop him and question him. obviously he realized what he was doing was wrong, because he let him go without even knowing his name!. if he had reason to stop him, he would have detained him..

officer in the wrong...period.

The guy does appear to be a jerk. However, bending over and letting ourselves be "subjected" to things that should not happen are the same behavior that put us where we are today. They took away school prayer, pledging allegiance to our flag, the sanctity of marriage by allowing gay unions and the list goes on.... We keep giving' in means we keep giving' up....

What is the cops responsibility if he is sent on a call to check on suspicious activity? Is a guy carrying a shotgun in an urban environment different then a person reported for weird behavior, like repeatedly walking in front of a house with an open garage or a truck pulled on the shoulder and a passenger just stretching his legs? I don't see anything wrong with this cops actions. The kid was baiting this poor guy and now he has something to show his butthole future lawyer fraternity bros. There are situations where the officer has to use discretion, I applaud him for not peeling that kids hat back.

I am in no way bashing LEO but most (as most any human) will try to get away with as much as possible. I think the LEO in the vid should have realized that this guy was not going to be push around and knew his rights and told him to have a good day.
They guy was firm and stood his ground LEGALLY.
The cop tried to push the limits.

I think most people here are missing another point. All of this happened because of ignorance of the common people as to what the law is. If people knew it was legal to open carry, it is very doubtful that 911 would have been dialed in the first place.

This guy then carries it a step further to show that not only does the average citizen not know what the law is, but some LEOs don't either. Yeah, he took it to the extreme to prove a point, but it is a valid point.
