We've had this same discussion regarding the stags that we shoot. They all still in velvet, but the direction was that they count as bucks. I don't agree with that since the antlers aren't hardened, but I don't make the rules.

I don't understand why the warden told him to use a buck tag. It seems to me that the fact the deer was FEMALE over rides the presence of antlers. Congrats to the little guy for an unusual deer. Look at your tags. They say buck or antlerless. Not buck or doe. Ahh, yes. Momentary lapse of judgement on my part. It's the same deal as using an antlerless tag on a button buck. Not so fast there boys The TPWD hunting guide clearly states that a buck deer has a HARDENED antler protruding through the skin. ALL OTHER DEER ARE ANTLERLESS. Those horns don't look hardened to me. I shoot a lot of stags.... The game warden in mason says antlered tag!!!! Also a few big bucks get shot still in velvet in TX... Legit bucks... Even though they are still in velvet they get tagged antlered

I don't agree with that since the antlers aren't hardened, but I don't make the rules. The rules are spelled out in black and white. If that antler isn't hardened, it's not a buck (period). In this case, that doe will never shed, which by definition makes those horns and not antlers anyway. So, the game warden has discretion here as to what he would tag, but the final say is from a judge who would interpret the law. Be interested to see if there is precedent here.
