Well sure the lease agreement is binding... but unless it states exclusivity its not exactly what our THF member thought it was.

This lease is like the gal on the corner of commerce and cherry, sure for a fee you can have your turn, but so can the next guy!

I would talk to the land owner,,,maybe he will honor your lease and tell his friend he can't hunt there anymore

yep, brother had a lease near Evant for 20+ yrs (uncle, cousin and my Dad hunted there too). Anyway, one season they began to find rifle casings in 2 different stands from calibers that nobody on the lease shot. So, either someone was walking onto the property (1/2 mile or so to get to the stands) and poaching or the landowner was allowing someone else to hunt on weekdays when they were not there. Hmmm, maybe that's why he always required a phone call from the leasees on when and how long they were going to be there. Never tried to prove anything and the landowner acted like he didn't know anything when they asked him about the casings. fact is, when you are not at the lease, you really have no idea what is going on.

I thought it was assumed to be exclusive unless otherwise stated. They are leasing the hunting rights. Can a guy lease the grazing rights to multiple people as well? Don't think so...

I'd agree with the guys above that said go talk to the landowner. Many don't understand how much time and effort and money you have put into hunting. Explain those things, as well as what you heard and who you heard it from... Good clear communications goes a long ways.

It depends on how it's worded, but it should contain something stating that the rights outlined in the lease are reserved solely by that individual and no one else.

"No one other than Lessee shall, at any time, be permitted to exercise any right or privilege under this Lease Agreement."

Can also make it perfectly clear by just putting a clause outlining in black and white whether the owner is allowed to hunt on the property during the term of the lease.

It's probably in there and the LO is just ignoring it under the, "what are they going to do?" assumption.

I have no plans to contact the LO until I have SOLID proof to do so. These days, you can't be sure who to trust or not based on their word.

If I get proof, a conversation will be soon to follow.

Buying a couply more GC's; so I can see what is really going on.

Where is this lease? Sounds like the same situation I was in last year around Blackwell. Just cut losses and found an incredible lease with a great LO this year...
