I know Texas is a cattle state, and I appreciate the fact that it is one thing that made this state what it is today. I am proud of my heritage! But it urks me a bit that someone else's cows can trespass on our place, tear up hundreds to thousands of dollars worth of stuff, and my only recourse is small claims court (civil suit). But if I harm one or sell it to get my money back it's a felony. Something just not inherently right about that. If it tears up my stuff, I feed it, and I water it, I would consider it more mine than anyone else's. But I have an uncanny knack to look at things fairly. I know, the world just doesn't see things the same way.

Great advice uhh pshycho?
Also your right I don't see things the same way.

Some good advice here. I would just fix the fence, it's just as much your responsibility to fix the fence as your neighbors.

I don't think he has cows that are breaking the fence, the neighbor does.

Call the police every time and try to get them to give them a citation for each animal every time and if they will put it on the report, document the fence destruction you can find.

Maybe incorporate a little sub S fence building company and post your rates. Send him the bill every time.

We had the same issue. Spoke to the Sherriff and Game Warden at seperate times and got the same answer. They said it was the responsibility of the property owner to put up fence to keep things out or off their property. Not the responsibility of the animals owner to keep them on their property.

Id say the easiest way to fix this is to put a fence around your place....i see this problem happen all the time, and its gona get worse because those farmers that have no water because of drout and cant afford a well or feed are gona turn there cows loose to get grass add water were they can. I know this sucks but even if you do get this problem solved the way you want it, you will still have problems like this for as long as you have this place.

When did you get enough rain to grow a food plot?

Not that it has anything to do with the subject.

What I've done in the past is call up the trespassing cows and pen them in the lot. Then I call the owner. There's no water in the lot. Owner usually gets there quick.

Texas is generally a open range state, however depending on the county and precinct your property is in, there may exist "Stock Laws" that limit the state open range law. Check with a county court to see what 'Stock Laws" are in your precinct before doing anything.

You can't rely on anything posted here without knowing the local laws specific to your location.

They make ammo specifically for hunting for a reason! nidea

About 20 years ago we had a neighbors cattle busting the fence. The neighbor had this nice house, with a big fenced yard that went completely around his house. We loaded up about 10 or so head of cows that had been in our wheat field. Took them to his house and opened the gate to his yard and put those cows to feed in his yard. With all of that fresh wheat in their system they "fertilized" that front yard.

His wife was screaming at us as we unloaded. The next day he fixed his fence and we had a "good" neighbor after that time.

Not going to air it on the forum, other than I don't feel bad for him.

Anyone associated with the dove hunting fiasco with the Frisco Horse park knows the tiny tip of the iceberg though.

That sounds like something I'd do. Pretty funny.

You have the right to keep the cows until they pay you for the damage and the amount the cows could have eaten. Make notes of everytime they come on your place. You own the land. Is your county free range or open range that makes a big deference. Contact your county clerk to find out.

Take pics of the cows and especially ear tags, brands, ear notches or other means of identifying. Use this for evidence. Provide copies to the Sheriff's Office or Animal Control.

Determine as near as possible how long the cows have been on your property. Then submit a bill to the owner for the "free grazing rights" that he's enjoyed as well as any damage the cows have done.

If he fails to remove the cows after a period of time the sheriff can impound the cows and even sell them at auction.

I had a similar problem with a neighbor and his goats. I repaired the fence while they were in my pasture then called the owner to come get 'em. When he arrived I gave him a bill and explained that he could retrieve them once the bill was paid. Never had another problem out of that neighbor.

This^^^^ is all you need to do and it will stop.

I'm a rancher and I don't have any neighbors that don't have cattle. Sometimes my cattle get on my neighbor, sometime their cattle get on me. We deal with it as civilized people. People without cattle are like people with no children, they can always tell you what you need to do! Cattle will stray onto other property, just don't get twisted off on the first offense.

When the destroy you food plot right before hunting season it is very frustrating. There is no way to fix that, the food plot is just ruined. And there is no real repercussion. None of my close neighbors have cows, but one neighbor a ways away has cows that get loose more than they should. Twice they have ruined my food plots. Next time, I may be eating cow.

I'll bet I know your neighbor! I do understand where you're coming from though.

I fixed that problem by removing my front gate. A guy that didn't have time to fix the fence finally figured it out.

so if a person was to somehow paint lines on a cow representing cuts of beef and return said cow to its own property....then closer to deer season put fake antlers on this bovine corn thief you think the owner would get the message
