Long story short I’m clearing trees on our property along the fenceline where we have highway frontage. I want to remove some trees outside our fence line that are encroaching onto our property but I don’t think I can. Anyone have a number or happen to know the answer? I’ve searched online but haven’t found anything at all, I’m sure I’m not searching with right keywords.

I think you can but from Google it varies greatly by county/city. If you are outside the city limits, I would contact your commissioner

Stop by the local TxDot office, they have maps of all their right of ways and will be able to help you.

If it’s a highway it’s most likely TxDOT there is a local office in San Antonio, call the number off their website and they will get you to right person.

Don’t touch them even with a stick….., this is my area of expertise and I deal with trees for TxDOT on a daily basis and if 22 people say yes you can cut them down and a month later some pencil pushing yo-yo sees they were cut and gets his feelers hurt he won’t even ask the 22 people that said you could cut them and simply figure out how much you owe the state for the tree. Just last week a lovely man got hit with a bill for an amount I’m embarrassed to repeat but it would require a change of undershorts if someone handed it to me. If you’re around San Antonio you’re double screwed because those people are literally nuts and the oh so majestically enchanted nesting bird they love so much will make your life a nightmare if you piss anyone off. The best of luck from Mr Tree killer roflmao

Cut what hangs over your property and leave the rest till you get permission to cut the trees.

What kind of trees? Brush? 100 year old oak trees? If txdot didn’t plant them id abide by it’s easier to ask forgiveness than permission. I’ve seen txdot cry about paying to cut down a carp load of trees never once seen them upset that one was removed. Trees in ROW are a liability for them.

Is this here in Texas? if so, get with your local TxDot field Maintence office in your area, 24 different districts around
texas, and most of them will work with you on this. Couple in East Texas, i would not give them time of day!

I know, retired govt worker from the state! I know all the BS that happens in local govt.

A few years back, the Limestone County Roads and Bridges guys wanted to widen a gravel road that borders my property. That would mean removal of some large trees near the road and on my property. I told them I didn’t want to do that, and they didn’t. If the OP’s road in question is a county road, I’d talk to the county folks. If it was a state road, I wouldn’t know where to start.

Ol Thumper sounds like a man that knows how things work.

Thanks guys, I reached out to TxDoT and they connected me with the local Hwy maintenance person. Took some
Pics of the areas and a brief description of the work and he gave me a thumbs up! Thank you THF brain trust appreciate the guidance. Only problem is the skid steer lost a track yesterday, it’s getting repaired Monday so my weekend plans got foiled. Came home to spend some time with the family.

And for those who were curious it’s scrub brush, cactus/succulents and cedar. No oaks outside my fence. TxDoT was already removing same vegetation closer to the highway so I added to their piles and just cleared area outside my fence. I’ll have to resume after the next big rain event makes uprooting much easier.

Yes, San Antonio is nuts. A customer calls and says he needs a big Mesquite cut and taken, it fell and was pushing up the sidewalk. He tried taking it down for years but the city told him it was a historic tree and couldn't be touched until it fell partially and they gave him x number of days to get it removed or be fined.

I wouldn't do it myself peep but if the state told someone they can't take a tree on the property line, said person could apply some Power Pellets. I tested the product on cedars along my fence back in February and they are dead as of my trip down there 10/1. I plan to use a lot more this February.

Yup, interesting. Do you just lay the pellets on the ground, or insert an inch or two into the soil?

Be cautious if you choose to use the Pronone. The active ingredient is Hexazinone which is the same active ingredient as Velpar. Hexazinone is water soluble and will migrate with water. Be conscious that you may kill plants outside your target area or in a deep soil that perks well, it can reach and contaminate ground water.

On a dark and stormy night, take your drill out there and drill ya holes in the trunks. Take the appropriate juice and fill them holes with said juice. Then when they’re dead ,, have em cut down.
