I am currently in a battle to keep fake conservationists and "others" off our land. This has been a bitter back and forth since they started sneaking onto our property in the 90's to put fake bird houses. Their hope back then was to get a rare duck to make a nest so they could apply setbacks on us. We stopped them. Now they are stepping their game up, because they want the public to be able to cross our private land at will... just so they can make money. This is our homeplace and has been what we "my family" have called home since 1887. I'm looking to speak with anyone who has dealt with this kind of issue. Thanks. God Bless.

Without quite a few more details it's going to be hard to understand what you're dealing with.
Trespassing should be controlled or at least curtailed by local leo / county sheriff.
Ingress, Egress, Encumbrances, Covenants - deed & a lawyer.
Eminent domain, EPA, US FWS / ESA, WOTUS - lawyers, money & time.

There is an area that borders our property that was taken in by a nature conservancy group 25 yrs ago as part of a conservancy easement. The nature conservancy, unfortunately, paid the estate of those landowners a good sum of money, but they got duped. The estate they transferred from has long been known on Caddo Lake as "untrustworthy" landgrabbers.
The conservancy was so eager to get their hands on land on Caddo Lake, they never bothered to do their due diligence. They never even got a survey and obviously never looked at the deed before they paid the other estate. That was 25 years ago, and they are just now finding out they didn't get ANYTHING they thought they paid for.
Instead of going after the estate owners that duped them, and whatever title company they used, they are now encroaching onto our land. I guess they are trying to save face for a busted deal made in greed. Unfortunately, for the Tree Huggers (fake liberal conservationists), my family and many other families on the north side of Caddo Lake have had this battle with the former estate owners several times before... and won every time. The conservancy thought they were dealing with a bunch of country bumpkins because it was Caddo.
For some reason, Liberals always think country folks are The Beverly Hillbillies.

I would think a cease and desist order along with a restraining order on the leaders would be a good start.

High fence with net wire. What I would do. Moment they cut that fence, you legal arguments just grew exponentially. Sounds like a DU scheme/project.. easements, ED, wetland designations, and ESA etc

Sounds like they bought land that is landlocked with no easement to get to it? And they are trying to sue you for an easement? If not that, would need more info. If your borders are fenced and properly marked with signage or purple paint, then make sure to call the law every time they trespass and press charges. If they do damage to a fence or anything during their trespass then sue them for it. Put up cameras. I would say you have nothing to worry about but the truth is the way things are now, you might get screwed and be forced to give an easement. If that happens youll just have to keep appealing.

is your property by goat island by chance. I know TPWD owns most of the land on the north side of caddo and there are multiple places where it is very hard to distinguish if you are on private or public.

To be clear.....Conservation easements are donated, NOT sold. They preserve land and manage it for conservation purposes. The landowners that grant get a big tax write off for the donation. But they DO NOT give up ownership rights. They just stipulate that piece of land for conservation of some kind. If they sell the land, the new owners have to accept the easement.

Know a young lady here, that is vegitarien. tree hugger if ya will, & she has some damn good views, keeps open mind... Hunting- has become all about the BIG Buck$ ... Low-income worker here,, were i grew up it was about pudding on d & in d freezer, cost of Gov. Food Stamps ya purchased at store... Twas a Blessing whin OSBWMA opened up ta public hunters, affordable hunting, gave up high priced leases, going ta highest bidder... Surveys and recorded Deeds are your friends. Shortly before we sold the family ranch a few years ago we had a new survey done. Turns out we picked up about 10 acres that weren't marked as clearly as we thought.

I would reach out to Nogalus Prairie on this one. I looked at a property that had a conservative easement with in it. It was part of the ranch acreage. the restrictions also came with the easement.

There's limited access to our property. Always has been only one way in and one way out, as 3 side are surrounded by water. Deeds and patents have been what has saved us... even during disputes over oil leases. Wexre a proud Texans, our roots go back to before the Republic, and it sucks that once the landowners gave up trying to cheat and scam us, they sold a sack of spoiled goods and (crooked surveys) to the State.

Not sure if the TPWD's role is the same with all conservation easements, but on this easement, the TPWD doesn't own any of the property... they are just managers of the conservation easement. The lake is can be very confusing, but not for most people who grew up on it. The conservation groups need to do their homework before they REALLY get screwed over by the easement grantors faked surveys. The owners granting easement, are probably the ones failing to show the numerous times the Texas General Land Office and the Railroad Commission have sided with us. We can prove, and have proved numerous times. It sucks to see anyone get screwed, especially the TPWD, because they do a lot of good work.
