Okay, question for you.. maybe more than one.

I own land in Edwards County. The land is part of a deed restricted Property Owner's Association.

Now, part of the restrictions state, "no day hunting".

So, there is an owner that lives in Mexico and he does day leases of "exotics. So.. get this... he owns 133 acres. He high fenced 133 acres. On this, he has a crappy single-wide mobile home and then a high fenced area about 20x20 and he buys a ton of mouflon sheep etc.. no idea where/how he gets them.

These animals are pathetic looking. He has way too many of them, they are skinny as heck, no water at all. They are skin and bones and you can literally walk up to the fence and they come up like they are begging for food etc.

So, our PoA cannot "do" anything. They filed a lein against him for not paying his dues, but they cannot DO anything unless/until he tries to sell....sorta crappy... no teeth.

We have seen buffalo on his land, that were dead and tons of buzzards. This weekend I went out to my ranch and he had all those sheep packed into that small place, it looked like they could not lay down due to too many in the pen.

WHO in the world can stop the guy?

Can the HoA pass a rule to not allow high fences and then force him to remove them, or have the power to do so if he does not? (lower them)

The TPWD states to the PoA that they are not responsible, same with the sheriff. It seems like people have tried and no-one seems to have the authority to DO anything about it.

We sure could use some help/input. The guy is just destroying animals and the land.

X2 As much as I dislike that organization, for their anti hunting stance. They do have some use. They can seize all his animals, and fine the crap out of him. If not jail time. However, with him l living in mexico it might be hard for them to enforce the later.

best option. they will leave him notices and when they don't get a response they can get papers from a judge to seize the animals even without his permission or presence. Sad to hear people do this kind of thing.

I get holes in my fence all the time and my cows always seem to find them. Always in the middle of the night.

Calling the humane society or pita would be the last thing in the world i would do. You have no idea what kind of bag of worms you might be opening. If there are no cameras around fix the problem yourself.

lol.. we will see. I know it is bad to see the animals that way, but I tend to think that err-ing on the side of being a good land owner is the best course of action, i.e. I'd rather not resort to seeing holes just yet.. lol.. but who knows, if we exhaust all other methods, you never know what a strong rain might do to his pretty fence.. even bring lots of corn down from the hills to entice the wild animals to gather in other areas of the wild kingdom :p

Call the local Sheriff's Office and see if they have an Animal Control Officer. If not, speak with a deputy. They can file charges if there is in fact abuse/neglect occurring.
