Possess would be the more accurate word, a convicted felon can't possess a firearm in texas but they can hunt with a bow or certain muzzleloaders.

The term “firearm” is defined in the Gun Control Act of 1968, 18 U.S.C. Section 921(a)(3), to include "(A) any weapon (including a starter gun), which will, or is designed to or may readily be converted to expel a projectile by the action of an explosive; (B) the frame or receiver of any such weapon…." Based on Section 921(a)(3), air guns, because they use compressed air and not an explosive to expel a projectile, do not constitute firearms under Federal law — ******unless they are manufactured with the frames or receivers of an actual firearm****** Accordingly, the domestic sale and possession of air guns is normally unregulated under the Federal firearms laws enforced by ATF.

An air rifle isn’t a firearm so there is nothing prohibiting possession, ownership or otherwise.

A felon who has completed sentencing or parole after a 5 year waiting period with no other offenses, may own and possess a legal firearm and can only use that firearm in their own residence for purposes of self defense. Full rights can be restored only through a pardon, which in Texas is extremely rare. However there is a movement gaining momentum to allow non violent felons who have completed their debt to society to have full rights restored after a waiting period. Probably will never happen in Texas.

But if you use said air gun in the commission of a felony, it can be recognized in court as a deadly weapon, thus raising the charge.

I think so, thats why I posed the question, and also why I think the tpwd commision was so quick to kill this regulaiton change for this year.

After talking with the sheriff department, the AG and game warden , the answer is yes . For now, until legislation reclassifies air rifles.

Just curious, but what would be defined as a “weapon”? Seeing as box cutters brought down airplanes and killed thousands, would that be considered a weapon? How about a box truck?

The 5 year window is Texas law for a felon to possess. Under federal law it’s a lifetime ban; so the feds can charge a felon with possession even if they are in compliance with state law

The Democratic National Socialist define firearm as anything that can cause fear when pointed at a person or object, including but not limited to sticks and fingers.
They further define Felon as anyone who disagrees with their definition of a firearm.
