So is it 10 acres needed....

So is it 10 acres needed.... - 02/22/13 01:48 AM

To hunt in the city? My sister is about to buy a place out in the country (technically Sherman) but there isn't anything but farmland and trees around. It's over 10 and is all together. Has lots of trees and a pond towards the back of the property that would be great for ducks/dove. Backs up to prob a 200 acre field. Needless to say I'm drooling

Depends on the city/county

Depends on the county regs for subdivision and city limits I would think. If it is not in a platted subdivision then a lot counties allow hunting if it is 10 acres or more. Check with the GW in that county.

"...a pond towards the back of the property that would be great for ducks/dove."

You'd better insure that your shot doesn't leave that 10 acres. If it does, then you're shooting across a property line and that is against the law.

Your projectiles must remain on your property.

Yep... I'm good with the laws regarding shooting across property lines and roads just wasnt sure about the 10 acre rule. There's nothing but open farmland for miles and miles around...No houses/schools close by either, so I bet I'll be okay. Pretty neat little piece of land actually.

If the land is in juridication of a municipality and was annexed after Sept 1, 1981, you can hunt it. 10 acres or more for shotgun and 150 feet from a residence/occupied building and 50 acres or more for rifle and 300 feet from residence/occupied building. If it was annexed prior to that date the city could pass their own laws which might prevent it so city would need to let you know.

Grayson county is bow only so the rifle hunting shouldn't apply. There were a couple of really big bucks killed on the outskirts of Sherman this year.

Re: So is it 10 acres needed.... - 02/22/13 10:52 PM

My house is on 25 acres. My city only allows dove/duck hunting on 50 acres or more, even though the county says 10. Municipalities have the authority to place their own regs as long as they're at least as stringent as the county's. (a town can say 11 acres, but not 9) We are allowed to "pool" adjoining property by getting written reciprosity agreements between adjoining land-owners (I can hunt theirs, they can hunt mine, etc) if the combined properties are 50 acres or greater. Doesn't need to "reciprosity," even, just written permission to hunt. There's a 250 acre corn field behind me, so I went and talked to the owner. Said I didn't want to hunt his place, just needed permission in order to hunt mine and maybe cross the fence occasionally to pick up a downed bird. Got him to sign with no problem. You might want to find out if that's possible where you live, if even an issue. Most cities statutes are available online through the city web-site, just hard to de-cipher sometimes. You may have luck with a word search for "shotgun," "shooting," or "hunting." Good luck to you.

I'd call city hall first. I'd much rather bother a beureaucrat than someone actually working for a living.

yeah i just figured the GW would know the laws better, but ill try city hall first. Thanks

I'm not a lawyer but I have heard that Gov Perry signed a state law that allows hunting with firearms on properties >50 acres within municipalities. I have been told that the state law trumps any city ordinance. Check with local LEO and GW on this.

This is the law everyone. Go read the entire text if you want. You can still shoot a rifle at hogs in Grayson. If outside a town there is NO minimum acreage there. If in a city with regs then you use the above reg. 10 for shotgun or 50 for rifle. No city in Texas can prevent hunting if you meet the size limits above and was annexed after 9/1/1981.

I have hunted dove in Dallas county for the past 6 years if that says anything. Land in Sunnyvale was annexed after 1981.

As someone who lived for years in Grayson Co. and hunted all over it I will give you this advice....

FIGURE OUT IF ITS IN THE CITY LIMITS!- and have the printed verbage of the law on you, in case somebody shows up telling you to quit.

Sherman's city limits go on for MILES into thousands of acres of GREAT hunting and I have been dove hunting within a mile of the Wal-Mart and had county sheriffs drive by and wave; one or two would even come out and hunt with us after their shift ended.

On the other hand we were hunting at the back end of a 600acre milo field that was behind the folgers coffee plant on private property and a sherman city police officer came out and said....

"This is inside the city limits and we've had complaints(no house within 1/4mi); you cant shoot guns inside the city limits."

We asked him to varify that and he just shook his head and said..
"you can bow hunt all you want, but not discharge firearms."

Was he wrong....I think so, but your best bet is to call

Dale Moses 903-821-1342 He is one of the game wardens for Grayson County and can clear things up; if somebody showed up and started to tell you to pack it up - he would be the best person to call and clear things up!

IF you live in Mckinney then im sure you have seen the great Frisco dove rodeo that goes on every year....if you can get away with that kind of hunting in a town as Uppity as frisco I think your good to go.

There are a lot of knowlegable hunters, landowners etc. on this forum. Some may be LEOs and attorneys but its still an internet forum and I would not risk legal cosequences based on info here or any other internet forum. Check with your local LEOs.

http://www.legis.state.tx.us/tlodocs/79R/billtext/html/SB00734F.HTM

Scroll to Sec. 229.002 a page down. If you are are not part of the city this does not apply. Shoot all you want. This bill is why you can hunt in the middle of Frisco still. It was a tiny town in 1990. Not sure how every cop or GW would know what exact property is in the city or not and when it was annexed but this is the law on the books. It is discussed every year on here and always falls back to bill 734 that is on the books and passed. Key is if you are in the city, when were you annexed in.

This is an interesting topic. We have been looking for land to hunt on with a suitable house around Abilene. We found a place near Hawley again (the first one was removed from the market). It is pretty heavily treed so I don't think my bullet will go to far. I'm not interested in birds as much as I am hogs and deer. I was thinking I would be ok with at least 25 acres minimum. Is that too small for blinds and traps?

True my comment was for deer hunting. I didn't even think about all of the nasty critters like hogs or varmints.

even if you get the OK from everyone you need to get approved from, don't be shocked when you have an unwanted oddly shaped snow goose pull up into your spread...
