Selling a vehicle to an individual - 05/13/22 04:04 AM
So, let's say I want to sell my truck to a buddy. I have the title. What's the process? Do I have to pay taxes?

Both of y’all go to the DMV, it makes life a lot easier. No, you won’t pay taxes, he will.

Bill of sale, sign the title. He pays the taxes, not you.

Just make sure you have something in writing prior to taking it off your insurance. Believe me when I tell you this.

Remove the tags, I didn’t and it cost me $1200 in 3 states for tolls. As far as tax’s go you e already paid your part so he will pay them on the sale.

Vehicle transfer notification, AND keep the plates. I forgot to keep the plates on the last truck I sold and my wife has spent countless hours trying to get overdue toll charges dropped. They come in the mail daily.

Just removing the tags is not enough to protect you.

Bill of sale means squat to the tax office for titled items. they only care about the 130u form and title.
However I have needed bill of sale for non titled trailers

You can not go wrong this way. If the buyer can’t go with you immediately tell him to let you know when he’s available and he can take possession of the vehicle then. It’s never bit my butt before with strangers, but I have a kid running around in a vehicle in my name a year after he was supposed to transfer the title. Yep, I’ve got toll bills.

You keep both your license plates.
This and this. Also call your insurance ASAP to get it off your payroll.

No reason at all to go to the DMV. I sold a vehicle for cash last year. I signed the title over to them and signed a bill of sale. Just make sure you take the plates off, remove/disable TollTags, and cancel insurance. I also took pictures of the buyer's license just in case something happened down the road.

https://www.txdmv.gov/sites/default/files/form_files/VTR-346.pdfJust did it. Simple as pie, transfer title, pay the sales tax, submit this.

Yes this a must, do not just sign the title over, because they may never bother with transferring the title to their name, then they make trouble like like getting parking tickets, not paying toll... and you are responsible, and will turn into a big pain in the asss. Don't ask me how I know.

If it is a gift or other transfer with no cost, are there taxes due to new owner?

Re: Selling a vehicle to an individual - 05/13/22 04:24 PM
130u form and title.
Also, there's another step. Go on line, same state site where you get the form. There's a place where you can actually update immediately that you no longer own it and have sold it. I've done this on the last two I sold.

If you and the receiver are qualified individuals, there is only the $10 gift tax. Normal transfer and registration fees apply, to change over the title. No sales tax

I will be keeping license tags off anything I sell from here on out. Last truck and trailer sold were toll fee nightmares. The trailer had been sold by the guy I sold it to 3 years later, and I got toll bills for it.

It’s a valid question. Maybe last time was 20 years ago. Things change. This was good subject matter. Just look at how many didn’t know about Vehicle Transfer Notification. Now a lot of members know.

I sold my Tacoma off of Craigs list. Had my eyes wide open. I wanted cash. Guys were coming from San Antonio to meet me in Lewisville. The address I gave them to meet was the parking lot of the Lewisville Police Department. They have an exchange area, with cameras. For the test drive, I wanted to sit in the back seat, didn't want anyone behind me. When they pulled out the stack of 78, $100.00 bills, I opened up a counterfeit pen and checked each bill. I had the form, title, did it all right there. One of them asked me, "do you not trust anyone, or just Mexicans?" We laughed our a--es off, shook hands. They put it on a trailer and away they went. I asked them why they wanted it so bad. They paid a good price and came all the way from San Antonio. They told me there was a very high demand for Tacomas in Mexico, especially the dry desert mountains. I left it right there.

I never see older Tacomas for sale. I see them in the caravans to Mexico coming east on IH10 from California all the time. I bet those guys have to stand guard over them, if they ever take a break to sleep.

i have sold many. As soon as I sell them I contact my insurance and DMV that it is no longer mine. Never a problem.
