120 acres or so Pittsburg County, OK

120 acres or so Pittsburg County, OK - 04/18/22 09:13 PM

Hey all. Came into about 120 acres in Pittsburg OK. Problem is that it's a 1/3rd ownership into the land with folks who haven't been there in 30 years. The land title says that it's no sectioned - i.e. has the ownership of the whole. I'm pretty sure that the other owners passed, and their kids/grandkids don't even know about it. Has a pond, and wet creek all year round. Great deer population. Was thinking about selling it and getting something closer to DFW area. Not sure how to price it - so if you're interested just shoot me a number.

If you're truly only a 1/3 shareholder, are you looking to move your 1/3 only or the whole 120; have the heirs of the other 2/3 agreed to selling their interests too?

Again, I’m not clear they know they own it. Could probably pick up their shares for cheap.

That sounds like the makings of a messy nightmare to me but I hope you get what your looking for.

I bet If the relatives of the supposedly deceased share holders find out they own land it will get messy very quickly. Who’s been paying all of the tax’s on it all these years? Is their a tax lien on it?

I asked the county that. They said some trust pays it as a set aside expense. My 1/3rd is only 20 bucks a year, so I imagine a few hundred in a trust would fund it for 30+ years.

I think he can in Oklahoma. Sell his 1/3 interest, but who would buy land and not have the controlling interest in it.
Who would buy the land without a title company guaranteeing it. Plus, he is going to have to prove that he owns 1/3 of the land.

My advice to him is to go to the court house and find out who the other owners are and if they have passed away,
who the legal heirs are and make them an offer. He may be dealing with children or grandchild of the original owners.
But without owning 100% of the property, I don't see him selling his share at market price if at all.

Do you not have to give the other owners right of first refusal? What’s stated on the title that you have as to how ownership is held?

He can sell his interest.

If a trust is paying for it, the other 2/3 might be in a trust. Would be able to find out pretty easily looking it up at the tax assessors office.

I am a land agent in Oklahoma. He can certainly sell his 1/3 undivided interest. I just handle a transaction very similar to this last week.

I keep getting letter making offers to buy 20 acres I HAD in Oklahoma. Deed was transferred back in January. The land grabbers aren't very smart!

Hell, I get calls all the time on my mom's house we sold over 5 years ago. Idiots scrounging Probate court records.
