I’ve given this a lot of thought and tried to wade through the noise. My take is that if you have one you are better off disassembling it and registering the lower as a true SBR and pay the tax. The “free” option is littered with gotchas and problems.
Your other options are to dispose of it or roll with it and ignore the rule.
Only you can decide and there is no one right answer for everyone.

So what I am understanding is... 1. You fill out the Form 1 with a photo of the gun, your name, address, phone number, etc. They have so long to approve it. If it's not approved in 88 days, then it's an automatic disapproval and now you are in possession of an illegal SBR and they have your name and address. Be careful as this may be a trap. They don't have to deny you, just wait past the 88 days and you are automatically denied. 2. If it is approved within 88 days, you now have a legal SBR and can take off the pistol brace and put any rifle stock on it, because now you have a Form 1 SBR. 3. You can just remove the pistol brace and replace it with a pistol buffer tube and you have a legal pistol. They just don't want you firing it from the shoulder.
And I'm sure the gangs and cartels are going to follow all these new rules.....

Not quite correct. The processing time is not the same as the background check time. You can have your form submitted and processing longer than 88 days. If the background check is started and encounters a delay or issue and isn’t completed in 88 days then it is auto rejected.
The thing to do is wait. Nothing can happen in the courts or congress (not that the useless idiots over there would do anything) until it is published to the federal register. If there isn’t an injunction or overturn by day 100-110, then figure out what the right course of action is for you.

I don't understand this video. I'm going to do some more research, but because I bought a legal CZ Scorpion, then added a brace to it I have to now destroy it? Simply taking the brace off doesn't turn it back into a pistol? What about SBR'ing it? My only two options are to destroy or turn in?

The thought process is that ATF is saying these braced pistols have always been SBRs, and therefore have always been subject to applicable rules. Imports that are rifles (includes SBRs) need to comply with 922r on number of US parts. If the brace was on it, it was a SBR, and if it didn't have US parts to make the points system for 922r, then it has to be turned in or destroyed. Perhaps you didn't put the brace on immediately and swapped in some US parts to satisfy 922r with plans to SBR it before you put the brace on...maybe then you don't have to turn in/destroy. That said, you should submit a normal form 1 (and pay your $200), not the forbearance form 1.

I just counted up all the USA parts and I'm sitting at 8, I'd need to change the barrel and trunnion to get into 922R compliance. Man I hate the ATF.

It’s not an import. Check the side of your receiver. Should be stamped cz USA.

Thanks, it does say Kansas City, KS on the side, but not sure if CZ USA is just the importer or the actual manufacture of the gun. Need to do some more research on it, but again thanks it would help a lot if it were USA made.
When I go to the Specific Form1 site for the new ruling the CZ Scorpion is listed as allowed so that is a plus.
