Anyone on here do Living Trusts? My mom will be here in November and she wants to go to someone and have a Living Trust done while she is here.

I live near Texas Motorspeedway but would drive 30 minutes or so for someone that comes with a recommendation.

Thanks for any help or advice!

You're good to start doing your groundwork now. You need an estate lawyer. Take your time and use as many resources/references (obviously, not just this place) as possible. And, once you pick one, don't be dead set on a single solution like a Living Trust. It might, indeed, be the best solution, but it sounds like your mom is a sharp lady. Surely she'll be open to what an attorney suggests is best for your family's situation.

We went with Trajan Wealth to set up ours. Also hired them to handle our Money after firing our last money advisors (US Capital Advisors) Think they have an Office in Arlington.

My mom already has a financial advisor…however she is looking to do a living trust instead of a will to allocate her stuff to who she wishes. (Without the probate and fighting amongst kids)

For this, you need an estate planning specialist, not somebody who writes wills on the side of his DUI practice. I would go for someone who is Board Certified in Estate Planning and Probate by the Texas Bar. It's means something.

It might be a VERY good thing if your mother did some serious research about Trusts. My wife is having to work up the details for her ex employer that died about 2 months ago. The trust that he & his wife set up DID HAVE TO GO TO PROBATE when the wife died in 2012, TOOK 2 YEARS AND MANY $$$$. The remaining part of the trust is now in the process of going to probate AGAIN.

Hi, I do prepare trusts as part of my estate planning practice. My office is in Lewisville (address in sig line), and you're welcome to ask on the TFF for references from folks I've done work for.

As dlallder pointed out, having a trust does not necessarily avoid probate unless the planning covers ALL assets. You can give me a call Monday, thanks.

Just PM’d you the lawyer I used for my moms estate, my estate, kids and spousal trusts etc. All he does is estate/probate/trust etc.

He 20min from you in southlake

Very satisfied so far.. Folks are very intentive. If you get a Living Trust set up, make sure Everything worth value is in it to avoid probate. That includes the Kitchen Sink.

Sent, I’m not sure how someone screws up trusts though if they are a trust lawyer.

If you need a litigation/probate lawyer I have a really good one in Forthworth. He don’t play, he is to expensive just for trusts though

Oh I understand, been through a litigation/probate issue few years back. My point was basically stick to specialized attorney. There are a lot of trusts that are pretty cut and dry, mineral, spousal etc. . Now evaluation for estate planning can be sticky, buy best you can afford. As a lawyer I’m sure you would agree.

Probate in Texas is pretty easy and straight forward - lots of living trust are sold to folks over the years that were really not needed - there are certainly other reasons for a living trust but avoiding probate is usually not the reason

I suggest using someone like this attorney who is an estate planning attorney

I have dealt with irrevocable life insurance trust for many many years - folks spend money to set them up and then do not follow the trust requirements which are: the trustee has to pay the premium - grantor does a gift to the kids (trustees) and then the kids or trustee pays the life insurance premium - this keeps the life insurance proceeds from being part of the estate and keeps it from being taxed -

If the grantor ignores the trust and pays the premium directly to the insurance company then the trust becomes worthless -

My wife is an Estate Planning attorney in Richardson - www.attorneypace.com

She doesn't practice any other areas of law. Estate Planning only. When searching for someone to do estate planning - make sure that's what they focus on.
