Hello everyone. Wanting to get a message out to everyone possible. Henderson County Texas has had a public waterway blocked off to public access. I private land owner has built a fence. Local county officials won't do anything about it. I posted a link to the petition.
Also on Facebook group" save the cut off". Alot more info is posted there also

I do not recall what state agency controls this kind thing, but local LEOs may not even know the rules. But I would think they should let you know who does.
Surface water and access has some tricky rules. You might want to try a state agency and let them determine whether there is something that needs done, if anything.

I can appreciate your efforts, but would like a little more information prior to executing a petition. Is there any more information you can provide? I saw the exert of the law you are referencing and it mentions the Trinity River and putting up a fence and dirt (I presume a dam of sorts)? If so, the first decent rain we get would take care of both.

If you can provide a little more information/pictures, you may find people more sympathetic and willing to sign a petition.

Just my 2 cents...

Local county officials may not be doing anything about a state problem. Have you contacted the game warden?

Try looking into the fb page "save the cut off" I'm trying to get info from there to here and my tech savvy is definitely lacking unfortunately

Good luck. Van Zandt county cut off the access to the Sabine River at Clark's Ferry years ago and got away with it.

Does the landowner legally own the land that was used as access? Is there a recorded easement thru his land to get to public land?

Here's all I could find on fakebook. It sounds like the purchaser of the land giving access to this part of the river doesn't want trespassing, unlike the former owner that must not have cared.

As I understand it, the state property extends to the natural bank of the river, not up into anyone's land. So, if the fence is down into the river itself, that is something that could be dealt with as it is state property, but if the river bank is too treacherous for someone to go through and the access has always been through the actual private property, it may sound like you need to get a boat to access the honey hole.

Without too many other details, it is hard to argue for or against this. as was discussed, pictures would be helpful. I know of plenty of river banks where getting through an area is impossible along the bank but I also know plenty where walking the bank is very easily done.

Yes you are in the right area. The access is at the end of fm 1667.
House bill 27 was put into law in 1931 after the trintt river was rerouted for flood control.
HB 27 states that the county commissioners of henderson and Navarro counties are to provide access to the original river bed.

Hey guys. I’m not sure if this is allowed or not so forgive me if it isn’t. Just wanted to get the word out that we are at risk of loosing one of the best hunting and fishing spots is Henderson County about an hour south east of Dallas in Trinidad Tx. A new land owner has purchased the Cutoff which is the old Trinity River bed. If you are familiar with it you know where I’m talking about if you aren’t you should give it a look. The best crappie fishing in east tx by far and some great duck hunting too. The General land office declared that the entire body of water was public in 2007. It’s been public access off FM 1667 since then until Wednesday of last week and the new land owner has fenced it off. The is an actual legislative bill named HB 27 passed in 1931 to procure a public access and declares it a public necessity. The state is trying to give it away and we are trying to get our voice loud. Please join us in helping to protect one of the best hunting and fishing spot in east Texas by speaking out and spreading the word. Thanks to all that are willing to help. It means the world to more than u can imagine!!

Trying to force a landowner in an unincorporated part of county, to do something with their property against their will, sounds like some commie stuff to me.

Yup. Straight up gave a nice public road to the landowner no charge.

A landowner who just so happened to be on some local govt boards.

VZ county is corrupt as hell.

the folks that complain when a citizen buys private property then they dont want the general public to have free reign over it should go pony up your money an buy then you can do what you want with it.

Sounds like Lake McQueeney. Unless you’re a property owner, you really don’t have access to the lake.
