Yep. Ask anyone that's actually been in a shoot that resulted in a death how much fun that is. Even if exonerated by law enforcement, there are always surviving relatives lined up to drag you through court for years, even if the shoot was clean. My cousin went through this a few years ago after being shot by a perp that had just robbed a convenience store behind his house. Nothing but a field backed up to his yard so no reason for anyone to be there, especially at night. Once he saw the car park at the dead end (car left running and lights off as the perp took off across the field next to his fence), he armed himself. When the perp came back, my cousin asking WTF he was doing there. Perp shot him in the leg and bolted for the car. Cousin dumped a 30 round magazine of green tip 5.56 into car. Perps buddy died in passenger seat. Perp was convicted of murder as a result of his buddy dying, due to his actions. As a result, both those guys were positively identified as having recently robbed at least 2 other convenience stores in the area. Passenger's family filed a civil suit against my cousin that dragged out for over 3 years. Fortunately, cousin's home owners insurance covered legal expenses because of where this happened but it sure took a toll on him. We talk about how different the whole story would have been if that bullet had hit his femoral artery or other vital area instead of a clean flesh wound.

Grand Jury?

Yes grand jury.

the group of 16-23 grand jurors are not present during the criminal trial itself; they are only employed during pre-trial proceedings. Their sole purpose is to determine whether there is enough probable cause for the prosecutor to file formal charges against a suspect and indict them.

Will an already “charged” person still be presented to the grand jury to consider an indictment?

Yes. Every felony arrest goes before a grand jury.

Thanks!

It's Dallas so the law is irrelevant - it will boil down to politics...

This is likely the case.

A Democracy is when two wolves and a lamb vote on the dinner menu. That is why this country was specifically not designed as a Democracy. We are a Constitutional Republic.

My warped mind thought…if more thieves, burglars, scum in general were filled with a little lead poisoning this country would improve immensely.

Dumb arse going to jail for protecting someone else's beer. I guess he thought the owner would give him a raise. It is petty theft of a buisiness, not someone armed breaking into his home.

What a way to screw your life up. Well, they got the beer back i guess.

In Dallas he is in trouble. In small town Texas no charges filed. I hate thieves and liars. If I were on that jury, I vote not guilty.

What happens when the thieves graduate to the next level? Banks, pharmacies, YOUR house? I hope I never have to answer that question.

Well, this one won't be graduating to any other offenses. Such a shame - it probably would have been his first graduation of any kind.

The really important part of these incidents to keep in mind is you don’t know what the shooter told the police. This was my main reason for posting. While I respect law enforcement, the detectives and police are not your friends in this type of situation. They will ask a question like, so why did you shoot? “Because I wanted to kill that MFer.” The police will happily record your statement. That’s their job.

A question you should consider. Can you, as a civilian, take a legitimate use of deadly force and turn it into getting charged by blabbering?

I bet 7-Eleven has a policy against such actions. The legal garbage they are going through far outweighs the cost of beer.
