Yes, I'd just keep the transaction in-state.

If you're selling it to an out-of-state buyer, you must transfer (Form 3) it to a Class III dealer in TX who will then send it to the out-of-state dealer on another Form 4.

The out-of-state buyer would submit the Form 4 AFTER his dealer receives it. Once the approved the Form 4 comes in, the buyer can collect it and the can.

George...once an NFA item is on a Form 4 it stays on a Form 4. It cannot be transferred back to a Form 3. So for an out of state buyer it would have to go from the seller to FFL dealer on a Form 4 ($200 NFA Fee + FFL transfer fee) and then to the buyer on a Form 4 ($200 NFA Fee).

Actually your wrong.

If you sell it to someone out of state, it will go thru (2) form 4's and (1) form 3.

- You sell NFA item to a person out of state.
- You have to transfer the item to a SOT Holder FORM 4 and there is the $200 tax stamp for the Transfer.
- The SOT Holder will transfer it to the buyers SOT holder on a FORM 3 (Tax Free)
- Once the buyers SOT Holder gets the item, he will transfer the item to the buyer on a FORM 4 (another $200)

If you have the right situations, you can a NFA Item can easily swap between a FORM 3, 4 and 5.

100%

I have only bought one and it is still in jail. All the BS has always made me turn away from buying one.

You're right about in state SOT and out of state SOT but stays on a Form 4 all the way. Cannot go back to a Form 3. Been there done that.

The worst part of the whole thing for an out of state sale is 2 waiting periods. Why even sell it if you aren't going to get fully paid for AT LEAST 6-8 months in the best case scenario (i.e. in state w/ favorable wait times)?

Silencers were added in the NFA due to the large ranch/cattle owner lobbies who were afraid they would be used to discreetly kill their livestock during the depression. They had a huge presence with congress at the time. You can thank them for the difficulty in possessing one.

You know it TRANSFERS Between SOT's on a FORM 3, NOT a FORM 4.

So out of state, it has 3 forms. Seller to SOT (Form 4), SOT to SOT (Form 3), SOT to Buyer FORM 4.

It did not stay on Form 4 all the way. Theres a Form 3 between SOT holders.

One other option that I've not seen anyone mention is that you can destroy the suppressor (hacksaw, welder, whatever) and notify ATF that it's toast.

Not something I would recommend unless it's been damaged badly in the first place, but it's an option for someone who just wants to get rid of one.

Yes, normally a NEW NFA item will go on a Form 3 between SOTs. However once it goes on to a Form 4 it CANNOT go back to a Form 3. Been there, done that and it was a PITA and took almost 4 years.

I have sold 2 cans to in state buyers. Get all money upfront, once the Form 4 is processed to the new buyer you need to hand it over.

Nope, even CURRENT NFA items, transfer between SOT's on FORM 3.

Have you ever had a SOT? I have. Whenever I transferred Machineguns & Suppressors to other SOT's it was always filed on a FORM 3. Why should I pay the tax when I paid for the SOT.

Theres NO SOT out there going to transfer a Item to another SOT on a Form 4. They'll all transfer them on a FORM 3.

By what your saying, you'll pay (3) $200 dollar tax's as EVERY Form 4 pays 200.

Form 3 is Tax free among SOTs only.

Also FYI:

When someone dies with a transferable Form 4, they transfer to the heir on a FORM 5 (Tax free).

It shouldn't. Pretty easy when buying new. Just know if you get into the NFA game then you are in for the long haul. You will most likely never recoup your money. The only NFA item that really gains substantial value are transferable machine guns (supply & demand, only so many pre-May, 86 samples left).
