There is a new neighbor on one side of us that has put up a high fence. Which I think is awesome for us. They built the fence a couple of feet on their side of the existing shared barbed wire fence. They also put in a 4’wx8’h gate between the two properties. I was concerned this gate was so they could lure deer from our side to theirs and shut the gate to lock them in. The gate is on a heavily used trail between the two properties.

When I was there last week, the gate was closed. A few of my lease mates went out this weekend and it was open. This confirmed my thoughts on their objective. I knew they were going to trap some of the deer on their side when they built the fence. And I've noticed a lot less pics on the cameras. So hearing the gate was open got us to thinking on ideas to keep the deer from jumping the fence over to their side and getting locked in. I'll be taking care of that this weekend. I called my landowners and the said they knew about the fence but had no idea about the gate. They're not happy.

One of my lease mates told me he was told by a landowner friend, that has a high fence, it was illegal to bait deer and intentionally lock them behind the fence. I can't find any information of this law. I would think it would be pretty hard to prove. Do any of you know if this is a law?

Just FYI, I'm not trying to go to war. I'm just curious if this is a law.

I know they want to trap as many deer as they can. And it's our responsibility to stop it any way we can from our side of the fence, legally.

Maybe I didnt read right. How do you know they intend to trap deer? Trapping deer inside HF or luring deer in and then trapping? Never heard of luring deer in but I’m ignorant maybe. Normally a HF is put up to control numbers by keeping unwanted deer out and not in.

welcome to hunting in Texas - my guess is you have no case - you cannot stop them from putting up a HF or leaving a gate open or closed - good luck to you

By trapping, I'm talking about opening the gate and luring the deer with corn, or whatever bait they want to use; leave gate open; and close the gate when they choose.

Again, I'm not mad at them. I was just curious if there was a law like my buddy said there was. I wouldn't think there would be but I could be wrong.

Just to clarify, I wasn't going to call the law or anything. I was just wondering if there was a law like my buddy mentioned.

Just tell the Game Warden. Had a similar occurrence but the gate was only open on top like a dutch door. Warden convinced him to weld the gate shut. I had actually seen corn as bait, but was never personally questioned.

Is it possible the reason for the lck of pics is because the deer were actually coming from the HF side and the fence is doing its job now?

Put up a scare crow right in front of the fence by the gate and call it good. The neighbors will get the picture pretty quick.

Or conversely, put up a camera facing the gate, see how often then are opening and closing and see if they are doing what you are thinking. Maybe the gate is simply to allow some egress for mowing or other work on the other side

Yes, the reduced amount of deer pics is because of the HF. But we knew that was going to happen. What we didn't expect was going to used like it is. We were actually glad they were putting it up. We’ve been hunting this place for 18 years and have been diligent with our management. I tell the guys all the time “we can only control what happens on our side of the fence”.

The gate isn't for mowing. There's only two feet between their HF and the existing barbed wire fence. I do plan on cutting two cattle panels in half, standing them up, and them secure to Tposts on our side of the fence in front of the gate. It'll be our Trump Wall bang roflmao

Set up an elevated stand right in the opening on your side right on the fence line and call it a day.

Per Texas buckeye ------- put a couple of cameras facing the gate and see what is happening, not just guessing.

I"d put a couple of feeders near the gate,,,, every time they open it the deer will come to your side to feed.

i thought most folks who high fence(depending on the size of the area) typically kill/clean out all of the native deer, then move in superior genetics?

Do they have legal access to your property to use gate? Just put up a small section of high fence across from the gate.

What is the difference? Having a HF and leaving the gate open to catch a deer or having a LF and having a feeder next to the fence to try to get the neighbors deer on your place?

Simple, just put a high fence in front of the gate. 10’-16’ section a foot off the fence line. Should take about an hour, to build. Essentially you can use two cattle panels and three posts

Was wondering the same thing....Also an open gate can let animals go in or out so I'm struggling to figure out how animals are only going to go one way and not the other unless someone sits there and closes the gate every time deer go the wrong direction.

You never really answered who has the cover. Do the deer typically reside on your lease and go to the other to feed, or is there an equal amount of feed and cover on both sides? If they're baiting, are you running your feeders already to offset the desire to go eat at the neighbors?

Since they put the HF on their property, and the deer could go either direction if the gate is open, I don't think you have any relief on this. Is it crappy? Yeah, kinda, but just do what you can on your side and stay legal.

If the above is correct, you're saying the deer are jumping the barbed wire fence pretty much directly into the gate opening. Hmmm...

I think I'd put up a camera as suggested to confirm what you believe is actually happening.
