In Texas, State Representative Terry Meza (D-Irving) has introduced HB196. Her bill would repeal the state's "castle doctrine." This doctrine allows a homeowner to use deadly force against an armed intruder who breaks into his home.
SHE SAID:
"I'm not saying that stealing is okay," Meza explained. "All I'm saying is that it doesn't warrant a death penalty. Thieves only carry weapons for self-protection and to provide the householder an incentive to cooperate. They just want to get their loot and get away. When the resident tries to resist is when people get hurt. If only one side is armed fewer people will be killed."

Under the new law the homeowner's obligation is to flee the home at the first sign of intrusion. If fleeing is not possible he must cooperate with the intruder. But if violence breaks out it is the homeowner's responsibility to make sure no one gets hurt. The best way to achieve this is to use the minimum non-lethal force possible because intruders will be able to sue for any injuries they receive at the hands of the homeowner."

"In most instances the thief needs the money more than the homeowner does," Meza reasoned. "The homeowner's insurance we reimburse his losses. On balance, the transfer of property is likely to lead to a more equitable distribution of wealth. If my bill can help make this transfer a peaceful one so much the better."

If this is true, my hope is someone breaks into her home. Beats the crap out of this stupid beech, and steals all her belongings. Maybe she'll give the intruder a thank you card.

Here is the bill. I’ve been seeing a lot of stuff about it, but reading the bill I can’t see much of what is being eluded to online and in social media in the actual Bill

Maybe I’m missing something but I see plenty of leeway to use deadly force to prevent burglary and break ins in ones own home

The truly bad part is that imposes a duty to retreat when not in your home. It also removes robbery or aggravated robbery as crimes where deadly force may reasonably be used to stop them.

No law-abiding citizen should EVER have a duty to retreat from a criminal, unless the citizen provoked the fight in the first place. Shouldn't matter where you are - in your home, in your vehicle, fishing on the shoreline, whatever.

This is insanity, the same type that infected our western states is trying to roost here. Not going to fly here. There are all kinds of misguided 'information' in her statement, especially about the reason crooks carry guns. Not going to even get out of committee.

Our new election administrator in tarrant county worked for Smartmatic in Venezuela for 12 years. He got his engineering degree in Venezuela. Somehow he was appointed elections administrator in 2018. And tarrant went blue for the first time since 1960. Right here in our back yard. Maybe Irving has similar influence? I'm not sure. My point? Maybe she wasnt purely elected.
