Question: Is he safe because you don't want to shoot him like this and want to wait until he has a full rack next season? Or is he safe because he doesn't meet antler restrictions. Because it looks to me as if he has one unbranched antler, even if it WAS branched previously . . .

I shot a half rack once. He had a fork on one side and broken on the other,

Our lease is one mature 8 or better so he no longer meets that requirement. While he has never been a great racked deer he is mature and I doubt he will ever be any better. Always been kinda wide for our area and fairly heavy horned but just no tine length. Would be a great cull buck on most ranches.
