Doesn't look like it is 2020-2 is applicable for Texas since we have no laws on private party sales. Really going to suck for the private party market if it goes into effect. I'll probably not sell anymore guns. Oh well, just grow my collection I guess LOL.

2020-1 Good. Now a Texas FFL holder can sell and send you a gun if you have a Texas CHL that exempts you from a NICS background check (and you provide them proof of your CHL status and a signed 4473 first). Not sure many will want to, but it does make it OK.

2020-2 Just better guidance for FFLs in places like California where the state requires all sales go thru a dealer.

So if I’m understanding 2020-1 correctly I could order a firearm from primary arms, which is based in Houston I believe, and they could legally ship it straight to my door provided I have a valid CHL/LTC?

Yea that is a huge game changer for me. I hate going to the gun shop and filling out paperwork and paying for a FFL fee. I'm going to be buying a lot more guns if this is the case. This could be a good thing or bad thing for me LOL.

Probably still a transfer fee involved. FFL services won't be free.

Probably still a transfer fee involved. FFL services won't be free.

If you walk into a gun store and buy a gun they don't charge you for the transfer. Should be same if you buy from a store and they ship directly to you. You're not getting it shipped to another FFL, them accepting the transfer, then doing the transfer with the customer.

I understand the FFL transfer fee, if I were an FFL I wouldn't accept a transfer and do the check for free either. Just saying it would make it much easier to get the gun shipped directly to you from the original FFL it should essentially make the FFL transfer disappear unless the FFL is accepting a transfer from out of state.

Im curious how many FFL's will be willing to do 2020-1. Seems like it could open you up to a lot of liability and potential for theft. Company I used to work for was one of the biggest online vendors in the country, and we had people dispute their CC charges from us on a daily basis AFTER they did a 4473 to pick up the gun. that 4473 basically saved us with the CC company in those instances. If the form was done remotely or mailed in, or whatever their intention is, that may not fly.

When I lived in Houston, I bought a can from Silencer Shop without ever setting foot in the store (when they still sold stuff in their location in Austin).

I bought the can online, uploaded my Trust, and when the Form 4 came back to them, I filled out and mailed the 4473 to them and they mailed the can to my house.

Should already be able to do that with firearms. I think that 2020-1 just clarifies the "how" for those FFLs that were confused.

Us gun owners need to start using this stupid COVID-19 crap to our advantage. Start pushing for more ways to exercise our rights without human contact!

It’s not illegal. It was seldom used but silencer shop started doing it before the kiosk. Their positions was its legal so we are just going to do it.

Not illegal at all. I was a resident of TX with my TX CHL, both of which Silencer Shop had copies of. The 4473 was filled out by me and they had the original. All super legal and Silencer Shop used to do this all the time.

More gun dealers need to do this too. Especially the smaller shops. Put stuff available online and you can sell to anyone in your state without them having to come to the store. I would help out a lot of dealers.

I think the atf applied some pressure. Essentially you can do this, but we really don’t want you to. But I could be wrong...


The kiosk is a better solution, which yet again involved them reading the rules and building it before getting explicit permission.

Everyone couldn't do it, I believe they obtained a variance from ATF. I did 2 transfers in that manner with them. It was a great set up.

Guess I stand corrected. I actually asked this exact question from my suppressor dealer because it’s about 1 1/2 hour drive for me to pick them up. I was told I had to be in his shop to fill out paperwork and pick it up. Everything else we did by mail. Thanks for the info.
