How is this legal. Pretty awesome but how is it legal? Any other time it would be open container but not it’s just a Togo order. Lol.

Tons of ToGo margarita and daiquiri places in Dallas. It’s only illegal if you drink it while driving or while in public (not in bar or restaurant).

Abbott included some alcohol sales for to go from on premise establishments.

Back home, Lafayette, LA really created the drive-through daiquiri thing back in the ‘80’s. They’re still there today.

They got around the open container law by placing tape over the straw hole when selling it to you, therefore it was indeed a sealed container when they sold it.

How is that not open container? They give me them in stir-foam cups already mixed ready to rock and roll. Be the same if I was rolling with an open beer in the cup holder.

Yep, a way to generate more revenue for restaurants. Had one from the local Mexican food place the other night. Was great.

It’s not all of a sudden. Also, think about the generation of revenue behind this sort of thing. They’re double dipping. It’s not just the tax on alcohol. It’s also the open container, dui, etc. Why would they not be okay with a scam like that?

I don’t know about the way you speak of, but there have been outfits that make drinks to go. Eskimo Hut, I believe, is one of them. Same thing, essentially.

Around here they must be sealed so they either give you a little bottle like on airplanes or a jug with a sealed top.

Because if I buy a beer and pop the top and don’t drink it but put it my cup holder if I get pulled over it’s an open container. If I buy a margarita I can easily pull the top off and drink it’s not an open container?

Eskimo hut in Angelo has been doing it forever. They give you a styrofoam cup with a straw in it, with a clear plastic bag that they put around it and seal with a little iron thingy
