So our last day on this property is supposed to be May 17 2020, the last day of Turkey season and the landowner txt's us and tells us we have to be off by the 12th of March because he has a cash sale on the property. I don't think his responsibility to our lease ends with the sale of the property. Any ideas for repercussions?

Sucks but after that date he no longer owns the property. You could ask the new owner to honor the lease but I seriously doubt he will.

If so obviously he owes you back ..
But from hearing from past experiences not much can be done.... I would ask for more reasonable time to get your stuff..
he has known about this a while on a closing that fast.. Sounds like someone is trying to close fast for 2019 tax purposes to get a write off...

Pretty simple....he told you he is not responsible for what happens to your stuff after that date. I would not risk it or devote time and attorney fees over it...

Is it worth it to hire a lawyer for two months of prorate reimbursement? Sometimes, ya' just gotta cut your losses and move on.

A buddy of mine lost 6 months of a lease and with 15 other people when the owner sold. The owner did not return 6 months of lease money. They discussed suing, but then realized what a pain in the butt it would be.

Exactly what I said in the other thread. Not worth the time or effort. I’d be more focused on getting my equipment off before the end date.

Since hunting leases are seldom filed of record it's totally up to the existing landowner to let the new owner know that it is sold subject to your lease. An ethical person would help you fulfill the terms of your lease with the new owner or refund a portion of your fee. The new owner probably knows nothing about your lease arrangement. I'd get my stuff, lick my wounds and move on.

as hard has it is to swallow I would just get out of there - by the time you pay a lawyer and your time it will not be worth it - sucks because a contract is a contract but in this case not worth the headaches

If the seller was any kind of a "honest person" he would offer a partial prorated refund. But those people are rare these days.

Move all your stuff off the land and ask the landowner like a man to reimburse you for turkey season. If he doesn’t tell him what a chicken chit he is and leave it at that. If he mouthes off someone will get an arse kicking. Then find a new lease. Whoever wins go on about your business. That’s assuming this is a west Texas rancher.

I would make contact with the new owner. He might let you finish out the lease. If he leases it out, you might be first in line.

File a lien on the property for the value of the lease.

"I don't think" - well, you might want to make certain and actually read the lease. Don't know if it'll matter anyway. Ours indicates if the property is sold, we get thirty days to move off our stuff. I feel your "pain" - our stuff includes four single wides, three tiny houses, four storage containers, a walk in cooler, 15 blinds., a D5, who knows how many feeders and whatever else.

Even if the lease does not address a sale, I understand the current owner's issues. The new owner doesn't know you and likely will not want to get involved in a deal set up by the previous owner. Legal means? Well, let's just see what that gets you. A big fat wish sandwich is all. If you need extra time, put it in writing (be specific), get it to the current land owner so he does not have to relay some sort of verbal promise and beg him to forward on to the new owner. if not, be prepared to go out of you way to keep your stuff safe and in your possession. I have heard of new owners locking out hunters and guess who's side local LE will typically side with.

Yeah, and then you run the risk of being arrested and charged with assault & battery. That's not smart.

From a landowner's perspective, I have the right to sell my land, this comes over your lease for hunting.

His responsibility, ends with the sale of the land which he no longer owns the day the sale is complete.

He could have been less than fair and not told you about the sale and let you lose what is yours on his property when it transfers.

Your only option is maybe the new owner will let you stay. Any legal options will take longer to complete than May 17, 2020.

Getting cranky with the owner will only distance him from you.
